Force Majeure

Does anyone know if force majeure would apply due to Covid-19? E.g. would the one year "good reason" expiration be extended due to Covid-19 on the force majeure clause?

Could force majeure work for the employees or is it only there to benefit Oxy?

Force majeure does not excuse a party from their contractual obligations. It only allows them to suspend their obligations during the force majeure period.

"If you're talking abut COC, I don't think there is a force majeure clause."

Force majeure should impact the Applicable Period. Article II (c). If force majeure could be argued due to covid-19, Oxy will not be able to reduce LAPC salaries further in August. Article II (c) states that clause (ii) of Section 4.2 (a) is "subject to such extensions of the Applicable Period as the Company may determine to be appropriate from time to time".
