Read earnings call transcript from last week - WARN Act should have applied

Read below...excerpt from earnings call last week. The bad quarter was due to supply chain disruptions, a facility being closed and inability to deliver 3 aircraft before the end date. But they are working through the issues and are getting funding from the feds. They expect to make that up in Q2. UPSHOT: They are not spinning this as natural disaster which would be required to exempt them from WARN Act. Still no word on if they plan any severance. I'm owed PTO they should have paid Friday too. Talking with my lawyer today. Someone posted here that its best to not hire a Savannah lawyer due to GS undo influence in region.   • I Also, someone posted here to make sure you record every call or conversation with GAC. Georgia law makes it legal to do so without you having to ask permission. Also good advice.

"...The biggest part of the story in the quarter was Gulfstream's inability to deliver 13 completed aircraft due to COVID-19 travel restrictions. We were able to pull two aircraft scheduled for the second quarter for delivery in the first quarter to somewhat mitigate the impact. So, net, we were down 11 scheduled deliveries. These planes are completed, the customers want them and they will be delivered as soon as travel restrictions are lifted and people feel safe traveling. The inability to make scheduled deliveries at the end of the quarter obviously did not permit us to recognize revenue and earnings on those planes. This is purely a timing issue. In fact, three of the aircraft have delivered this month, three are scheduled to deliver in May and the others are dependent on travel restrictions imposed by or on foreign countries. We are hopeful for prompt resolution of these issues...."

There were a lot of over 40 let go in October. If they signed the form, they can't sue but information on their ages might help show a pattern for this lawsuit.

I concur with the age discrimination. I am sure there are exceptions, but I have seen many old co-ops/intern and late 50 people who were let go in engineering. Can't be a coincidence. I suspect they let go young people and older people and kept the mid-age experienced people (who still need job security). There was an "employee evaluation matrix for reorganization" that was distributed to managers a few weeks ago. A lot of the guidelines were not followed.

Like some here, I’m working with a lawyer who thinks theres an age discrimination case.
Was told that GAC has to give us info on the ages of all of us they let go. They let us old guys go in RDC permanently on one hand when they claim disruptions are temporary on the other. I’ve worked my butt off for the place for many years. I was never a lay-off target before because I was performing at a very high level. Sailed through. Now I’m gone. I was performing at no less a high level. Best review I ever had at GAC was recently. They only reason I can think they targeted me was because of my age and corresponding salary.

I agree. They had people being productive and working from home for about 2 months prior to this sudden lay off. They should do whatever they can to get these planes delivered and get their employees back to work. Not sure about suing, but would be interested in what a lawyer has to say. Keep posting, please. Also, wondering how many laid off were 40 or older? I did see a lawsuit in 2000 about age discrimination. If you were over the age of 40, can you please indicate by replying with a "Yes," or a "No." Thanks. And, for me, it is a Yes.
