The no compete clause in the package

So Friday I finally get offered a package. I am reading through the paperwork with a huge smile on my face until I get to the part where it says you can't work for a competitor or compete with them for a year.

Smile wiped right off my face. My plan was to leave with the package and go to work for one of our biggest competitors. Does anyone have any experience with them enforcing the no compete? I have been told they cannot enforce it. I am not sure I am willing to gamble on that. You would think if they want rid of you it wouldn't matter.

I have a standing offer from our biggest competitor, but i can't go for the simple reason I was flat told by the SRO he would make it his goal to make sure i didn't work for them, all because they have taken all our customers and he and the MRO are jealous. I turned down two so far. I wouldn't take the chance. One of our sales people went to a competitor and they jumped on that right away. The only safe option is lay low a year.

In Colorado a 911 tech took the VSPP and immediately took a job with the company that has been stealing all of our 911 accounts. Zero consequences.

Having a nice life except for the greedy executives.....ALL OF THEM! The clause shouldn’t mean anything to anyone. After all, the executive team do not follow agreements they make with union workers when it come to call out pay, standby pay & compensation that they willingly negotiated on & signed. The smugness of the executive team is profoundly arrogant & condescending towards the very people that make the company money. Make no mistake, this executive team brings no money to the company, they simply take & take & take at the expense of the employees. Hell, they will leave a system with up to 499 customers out of service for days on end, simply to justify laying off more people to fatten their pockets. BRING BACK GLEN POST!

This is a company that can't even come up with a process to maintain their CPE or ISP gateway inventory. Or coordinate a successful install time with the customer. Do you really think they're savvy enough to catch this? Take the buyout, keep your mouth shut and enjoy the new start.

Don't update your LinkedIn, I highly doubt they will check the TWN. Run the offer by the lawyer, but they won't tell you how to cheat (at least the proper lawyers won't) but will give you an idea what will happen if you'll get caught

Talk to management. If they will not remove the clause. Take a vacation until it expires. In a work to right state this clause has not been added in any VSPP offers in legacy Qwest employees.

Get a consultation with a local employment lawyer before you sign. Enforceability varies from state to state.
