The reason the Court allows for Amicus Curiae filing is to bring to light relevant issues that the Court may not be aware of, to facilitate the Courts reaching just and equitable resolutions to the cases brought before it.
We have standing in the instant case as American citizens, farmer advocacy organizations, Dairy farmers, members of DFA, and shareholders of Dean Foods.
The Court may not be aware; DFA murdered Dean. Granted Dean should not have been hanging around with mobsters. Based on our observations of this Courts’ behavior, it appears to be prepared to reward the murderer with the victim’s house, car, boat and bank account. No questions asked, “I’m sure you can work this out.” Judge David Jones addressing the lawyers of DFA and Dean, February 19th, Hearing. Meanwhile this Court has thrown the wife, children and family dog (Dairy farmers, shareholders, teamsters, stockholders, unsecured creditors, and bondHolders

I heard that Dean said they're going to run out of money and blames coronavirus. Are the non-APA plants getting any bids or waiting for Chapter 7 on that? Will the DOJ approve the DFA merger before it's too late?

Lol...1117 doesn't refer to this brief...it's Dean Foods response to the bondholders and shareholders...and it contains a number of questionable opinions that are presented as facts.
But let's be honest here- everyone involved is fighting for money. Today's hearing made it certain that the only ones that are going to get any are the lawyers and execs. Appeals will make more money for the lawyers. That's it. Most plants are going to get sold to DFA and the only important questions still not answered are just how badly employees are going to get screwed.

Just a bunch of complaining written by a recent law school graduate and son of a couple butt hurt farmers who hate DFA. Amicus Curiae or “friend of the court” is a motion filed by somebody who is not a party to the case. After you read this nonsense, try reading doc 1117 which is a complete legal takedown of this motion.

DOJ is already mad and prepared to file a lawsuit in federal court. Stated that this sale is a major antitrust violation and all attempts by the DOJ to ask questions and raise concerns about the sale to Deans/DFA have been met with silence.29

Wow, stunning. Who filed this, can you pl. provide docket #? That stupid website isn't working. FYI the shareholders Ad Hoc Equity group was punished by the judge, so they've appealed directly to the DOJ and are asking to REMOVE the judge from this case. They will file with Fifth District and then appellate court, and if that doesn't work, Texas Supreme Court. Equity group is also planning to fight this out, as it has been a scam from day one - collusion between DF and DFA.
