Contractors are still covered under FELA. So they can sue the railroad. Whoever told you otherwise, does not know what they are talking about. Anyone working on railroad property are covered under FELA. 1% liability is all that is required.

Union or no union there are lazy people at every company. You just have to remember about contractors they do what they are paid for as quickly as possible no more than that.
The good ones can work for the contractors, sometimes with better benefits, similar pay. Since you’re worried about suing, you can sue whomever you want. If that’s your concern, you probably won’t get recommended for a job with a contractor. Good luck.
Good workers, bad workers, lazy workers, hard workers. Do you really think that makes a matter when UP can get contractors with their own benefits and when they get hurt can’t sue the company? It doesn’t matter who you are, we’ll be gone.
