Do we have to sign away unemployment rights for Severance?

Hey just wondering if you take your severance is part of the paperwork to sign away your right to collect unemployment?

Absolutely not. In the packet I received, on the second page it has it's own bullet: "Signing this release will not affect your right to seek unemployment compensation benefits". I know in my state, after a lump sum payment, unemployment is able to be collected and severance doesn't affect the overall amount to be paid at all.

States' treat payments differently. In some states, such as Minnesota, one is required to report severance amounts, PTO payouts and weekly gross compensation in order to receive unemployment benefits. In this case, one would not receive unemployment benefits until a sufficient number of weeks had elapsed which would represent the severance/PTO payout's equaling of normal compensation.

Other states, such as Illinois, regard severance and PTO as compensation which was earned during the course of employment, making one eligible for unemployment payments immediately after being exited.

Unemployment woul89d only start after the severance period is over. If you get 4 weeks severance....you cannot get unemployment for those 4 weeks. If still unemployed after that 4 weeks...then you can apply and receive it.

Check the rules in your state but generally after you get your lump sum with your final pay you can then file for unemployment with the state your in. But make sure you look at what you are agreeing to with the severance if they are trying to get you take the severance instead of unemployment. Hopefully UHG is not screwing people over but they probably are since they are cheapos and worthless Aholes.

That severance agreement is so airtight, you will never have a possibility of ever bringing any claim. The first hurdle is the agreement to arbitrate. There are exceptions to arbitration but you are wedged in pretty tight. There is a clause that states that if you bring a False Claims Act Action and are successful, UNH gets the award. You cannot take the severance and file a claim.
