Windstream filed a motion to get the Uniti lease recharacterized as a financing lease, not a true lease. (True) lease payments go to the head of the line in bankruptcy ahead of all creditors. On the other hand, if the lease is just a financing arrangement, then it becomes a form of unsecured debt and Uniti goes to the vey back of the line of creditors.
Uniti has moved to have the bankruptcy judge just summary dismiss this move out of hand as blatantly bogus. The hearing on Uniti's motion for summary judgement is tomorrow:
