The thing that makes UP so mad about this is the complete lack of respect from an employee towards the company. I’ve known people that have been brought back after much worse and so do you. Some people were brought back after much worse and never had to go to the appeals board. People with known safety issues that people were scared to work with. People that had made actual verbal threats against fellow employees. The list goes on.

Just shows that they think their decisions have priority over federal law, government, judicial rulings, and I guess that they do, because we are watching it happen in real time. FRA, Unions, STB, all sold out.As sad as it is, It will probably take the accidental death of a person affiliated politically (someone that matters to the public) , relative of a senator or representative,etc. , to bring attention to the lack of maintaining and understaffing issues.

Rhonda Ferguson is an id–t. This fits into some crackpot hail-mary legal strategy her department has dreamed up. Settle with the sh–t-r not to come back and keep your mouth closed - the UP messed up procedurally. Things like this happens when talent abandons the company. How did corporate communication ever think this would be a good idea?

Nobody was ordered to tolerate the employee. The arbitrator said UP should have ensured he didn’t have mental health issues prior to firing him, and they’d be justified in terminating him if they had shown he didn’t have issues. And if he had mental health issues, they could have put him out indefinitely until he proved to be fit for duty.

For those that don’t want to go on twitter, they provide a link to an article on the incident along with their own caption which reads:

“No company or fellow employees should be ordered to tolerate an employee who defecates on property, throws the feces out a window, gives the middle finger to the security camera and suggests to his boss it’s a present.”
