"The Federal Communications Commission (FCC), led by Chairman Ajit Pai, has issued a Notice of Proposed Rulemaking (NPRM) that it is considering ending or reducing the current requirement for operators of copper-based outside plant infrastructure to make that infrastructure available for sale or lease by potential competitors."

And that is why they lost the lawsuit (and should have lost) - TT and the Gboys rushed to complete the deal before the loophole closed - bypassing the 'formality' of getting the approval of the bondholders prior to spinning off assets in order to complete the REIT. So Cute

I still wonder why the SEC is not investigating. If it looks like fraud and if it smells like fraud, then it is probably............will let the Judge Drain finish that statement.

CS&L the actual company we spun off was a REIT the new company uniti is a competitor carrier after it's acquisition of southern light.

A competitor that owns our assets that we maintain at our cost,. The tax loop hole they were exploiting got shut off back in 2016.

Because Uniti is legally structured as a REIT (Real Estate Investment Trust), I don’t think they can operate the assets they own. I think maybe they’d lose certain tax advantages.

I’m not totally certain — if someone knows for sure, chime in.

And that's true.... except for all the fixed wireless antenna sites, the OSP fiber and wholesale customers, all the transport gear, all of the offices that gear sits in, and all of the on-net 1G/10G/100G circuits we support.

Or, maybe techs will report to Uniti after the bankruptcy. The same dweebies who were confident we would win against Aurelius are confident that we will be fine with the Uniti proceedings as well.

Yes, the fear you speak of is fear of losing ones job. Officesuite and SD WAN requires a few racks in a data center, not a CO. So, no net techs, no engineers, and repair teams will be outsourced completely. Wont really need any NOCs as there will be no network or environmentals. Utilize channel partners, so no need for internal sales teams. They are already starting to outsource customer installs, so no business techs. Windstream can get under 500 employees pretty quickly.......thats the fear. And that is 100% the plan. Its the only chance windstream has at staying in business.

People still want T1s. I've been told that many times. Because it's dedicated.
CLEC is a huge portion of Windstream business. Yes, old technology but it works. Windstream can't get anything right and people do not want to be moved or have their service changed

The CLEC portion on the game is OVER as of this February. We no longer get wholesale pricing. This is why we are tuning down the TDM network and moving as many customers to broadband. The REAL problem is we have SOO much legacy network out there it takes years and we only have months. Most of the product conversions are going to CABLE and 4G on SD-WAN. No WIN transport in play anymore unless it's on-net.

The CLEC business as we know it is gone, look at all of the VoIP carriers out there now.
All you need is a softswitch and an SBC to provide service. None of this T-1 and CPE installations of the past to provide service.

Isn't this the go forward strategy anyway? I dont listen to the C-level pep rallies so they may be saying something different, but from the outside looking in, it sure looks like dropping anything that requires a lot of people or infrastructure or dependence on non-outsourced workers is the plan Stan. Just a few C-level, VP's and engineers to funnel any money to (okay not the Engineers, lol)

Removing the price caps has already effectively ended the ability to operate as a for-profit CLEC. This is another nail in the coffin.
