A former senior account manager from UnitedHealth Group Incorporated has sued the company and two supervisors for an alleged "illegal systemic pattern and practice of discrimination and retaliation against older female employees." 40 by not properly evaluating their performance on the same basis as younger employees, and by retaining, promoting and elevating older women to leadership roles.
According to the case, the 52-year-old plaintiff sold insurance products to companies from 2007 until its unlawful termination in June 2018. In her tenure, the plaintiff has achieved her sales goals in just one year, claims the complaint. Beginning in 2017, the defendants, the suit says, sent the woman to meet "unrealistic" sales benchmarks from 2018. After falling short of these goals, the claimant was reportedly selected and issued a performance warning. The suit points out that younger male employees who have also failed to achieve the same goals are unlikely to have received such warnings.
The plaintiff, through her lawyer, continued to approach HR about her treatment, the suit says, and stated that she suspected her performance warning had been issued on the basis of age discrimination. Despite the women's concerns, no action was taken to investigate or rectify the situation, the case says. Instead, according to the suit, the claimant began "denying access to key meetings that are essential to its successful performance," including sales events and telephone meetings. The case claims that the woman was eventually fired in retaliation for tackling the alleged discriminatory practices of the defendants.
