Thread regarding Union Pacific Corp. layoffs

Anyone know if you can sue for a hostile work environment

When I lay off Lk LS my co workers make snide comments. When other co-workers lay of FMLA people make nasty remarks and harass them for Being off due to family and medical issues. Now my problem is is that the company puts your lay off status out there for everyone to see therefore creating a hostile work environment at times. Seems to me that it’s nobody’s business when I or others lay off and how we lay off. I wonder if the company does this on purpose. All I know is that create a hostile work environment and I’m pretty sure that is illegal.

@OP: Yes, you can, but you need to be able to demonstrate beyond reasonable doubt that the actions taken are definitively hostile, manifest a pattern, are directed towards you personally, and have a detrimental effect on your performance. You also have to report it and give the company an opportunity to resolve the problem internally first, otherwise it will probably be thrown out of court.

You would be suing UP in federal court, and that is going take a long time and get very expensive. My advice is to find a job at a better company. That shouldn't be hard to do, considering that UP was the worst place to work in 2019 according to Glassdoor.

You will need evidence or witnesses of the harassment. You will need to report ot to company through whatever official channels are available. Then, if it continues and the company does nothing to prevent it you have a case. Every step of the process will need to be documented. That being said, minor snarky comments from coworkers won't cut it. It will need to be something a little more serious than that. If you've got thin skin then the railroad industry is probably not for you.

Hostile work environment may not be illegal but retaliation for missing work on medical or disability is. It’s kind of hard to prove though unless you have it in writing/video/audio
