Windstream bankruptcy site (http://www.kccllc.net/windstream) just posted a notice that the judge will hear arguments on the validity of the Uniti lease on 11/21.

I've been confused about the hearing and litigation timeline.

I visited the link to today's earnings call (@11Unmjlj) and I noticed a seekingalpha.com reader had pointed out the confusion:

[Management] mentions litigation commencing in March against UNIT, but doesn’t mention that it must assume or reject master lease first week of December. WIN running out of options and no leverage against UNIT.
Not accepting = liquidation of WIN.

PS, in the unlikely event that the court rules in Windstream's favor, there will be dancing in the streets everywhere except Uniti. That frees up money for lots of people.

While such a ruling is unlikely, this would push Uniti over the edge into their own bankruptcy. That's why they may settle before 11/21 just to remove that uncertainty.

The whole legal thing is very confused.

No. Windstream has been making monthly payments according to the lease throughout the bankruptcy. This is required unless the bankrupt company formally elects to "reject" the lease and vacate the property.

Or, in the case of Windstream, try to get a court ruling that a lease never existed in the first place and this was just an unsecured financing deal (in which case, Uniti would get what other unsecured creditors will get – very little after all the secured creditors get paid first). That's what the November hearing is all about.

If I'm reading it correctly, Windstream wants an extension to pay Uniti, on top of the 90 day extension they already had? If Windstream is requesting more time, because they don't have enough money, then they will have to get there the only way they know how... Get ready for more layoffs people.
