Average Age of the laid off worker

I don't know anyone who even asked for the age information when they received their severance. I'm pretty sure most people aren't even questioning the package, just grateful to get one. And that is what UHG banks on. I'm certain also giving laid off workers X amount of days to sign and return the package is considered "under duress". I will be looking at mine and consulting a professional prior to signing one if I get laid off. The people complaining about WARN and age discrimination aren't helping themselves or anyone else by being silent. In the IBM case, the actual severance documentation was found to be in violation of the EEOC. All of the bullet points the OP listed are known in UHG. #2 is Optum's Freshers /outsourcing. #3 was the VSP offered last year. #4 is a known fact and has been posted on this site previously. #5 is a standard practice in the MN office.

So when I got laid off there 4 years ago, this list included everyone... even those under 40. So either they changed it, or whoever is compiling it is doing it wrong. One if the VPs that was laid off a little before me... at age 62... consulted an employment attorney. The response? It's UHG... they have hundreds of lawyers on staff just to fight these types of cases. You will never win. Sign it, get your money and move on. Food for thought if you really want to try to pursue this. You better have a big group of people going after them together... or it's futile.

They give you that sheet, but what they do not give you is all of the ages of people that were layed off in the entire round of layoffs the only thing they give you is people your same age or over 40, that is not the intent of the warn act, The intent is to get all people that were layed off in the layoff round and their ages so that a determination can be made as to what percentage of people over 40 were let get compares to the percentage of younger people that got let go under 40, UHG thinks you are stupid they wave a couple weeks of money in-front of you and say you have access to job-placement and to other assistance however that is a lie as well, IF YOU SIGN ANYTHING THEY GIVE YOU YOU ARE SOL DO NOT SIGN ANY DOCUMENTS THEY GIVE YOU OPTUM LEGAL HAS BEEN WORKING ON THIS Sh– FOR YEARS. THEY HOPE THAT IN THE PANIC OF GETTING FIRED YOU WILL FORGET ABOUT YOUR LEGAL RIGHTS AND TAKE THE PETTY CASH THEY GIVE YOU. THE BIGGEST THING YOU SIGN AWAY IS YOUR RIGHT TO SUIT THEM FOR ANY WRONG DOING. AND A LAWSUIT SHOULD BE FILED TO CRAWL UP THEIR A– AND MAKE THEM PROVE WHAT THEY DID WAS IN COMPLIANCE WITH FEDERAL LAWS. I WILL BET AS GREEDY AS THEY ARE THEY CUT CORNERS I CAN TELL ALREADY BY LOOKING AT THE AGE OF PEOPLE LET GO, THERE IS NO ONE ON THE LIST UNDER 40
