Seniority with “old Sears” is not mentioned in the agreement. Us long timers are worried we will have to start from zero again?
What will happen?!??!?

30 years working for kmart. Losing job in 1 month. Eddie is a lying, cheating , rat b–tard. I get satisfaction now of watching the slow death of his fantasy. Shop your way, what a joke.
I have been with sears for over 20 years
I am getting out of dodge while the getting is good I can assure you transformco is not going to make it. Run before you have nothing
Life insurance Cancelled for Retires
I'm sure you can see that the comment wasn't my own, it was copied and pasted from a Q&A form that was sent to employees. Not sure if it was just for Hoffman or the whole company.
There is not guarantee, so I cannot say it will happen, It's just what the company is saying will happen.
"Yes, your SHC service will be counted by the new employer and you will retain your seniority"
And you know THAT HOW ????
Brand new company, brand new employment agreement, and ABSOLUTELY NO MENTION of transferability of seniority rights
ANSWER PLEASE !!
5) Will my service be bridged to the new company?
Yes, your SHC service will be counted by the new employer and you will retain your seniority
What good would a sit down do? It’s a new company, they’re not obligated to keep anyone.
You do realize if Eddie hadn’t bought this thing everyone would be about two weeks away from unemployment lines right now. You’re concerned about seniority?
Take it as a favor, if you don’t like it you now can find a job before your store closes if it does. You’ve still got however long Eddie wants to mess with this or if he just decides to close your store alone probably two months for the liquidation.
OP stated this:
Your seniority is out the window as you will be signing a NEW employment agreement with a NEW company - your only hope is if a boatload of peeps organize a petition or stage a sitdown at HE demanding seniority rights

My guess is that there is no concern enough for a single reporter to cover or even document any wrongdoings by Holdco. They haven't happened yet. Look at what happened with the people that are still owed severance that got shafted. Not worth the effort. Nobody will be interested after this ball of twine gets unwound. Good luck to you! I got out and landed a job that cares about their employees.

The only 'zero' here is the person who is not employed by Sears/Kmart yet wastes their time posting in a Sears/Kmart forum.
As per Regional Operations, in California we will get paid out on vacation as per California State Labor Law and will start from zero but service time will continue as it was before. I will continue to get 4+ hours of vacation every two weeks. We will not get paid out on any unused sick time. Check with your state labor board for your specific state.

The following circumstances may disqualify you from collecting unemployment benefits:
01) Insufficient earnings or length of employment. Eligibility for unemployment depends on your earnings during a designated base period, which is typically the past year. This also means you usually have to have worked for your employer for at least a year.
02) Self-employed, or a contract or freelance worker. Independent contractors are technically self-employed, so they cannot receive unemployment benefits.
03) Fired for justifiable cause. For example, if your employer alleges misconduct (such as violating a company policy), or some other inappropriate or illegal behavior that leads to you being fired, you will likely not receive unemployment benefits.
04) Quit without good cause. The definition of “good cause” varies state by state. However, common examples of quitting without good cause include leaving to get married, attend school, or resigning because of a labor dispute (such as a strike). Another example of quitting without good cause is leaving simply because of dissatisfaction with the company or job.
05) Providing false information. If any information in your unemployment paperwork is inaccurate, you might be disqualified from receiving benefits
Item 1 -- If sign a NEW employment agreement for transformco and fast eddie decides to shut down or file for ch. 7 within a year or so you "may" NOT be eligible for unemployment insurance - this new agreement has all the hallmarks of this happening 😯😯😯😯😕😕😕
Back in 2005 when Kmart bought Sears we ran on two separate systems for quite awhile... then some HR processes were merged over but your service time with the company was kept intact. This time it seems to be a new ballgame so the past may not be a good predictor of what's going to happen. Having seen previous posts of vacation time being paid out , the signing of a document and some other quirks, I can only think that past service time might not carry over. It now seems like what's happening is similar as if you quit Sears/Kmart and hired with a new employer. They might negotiate your vacation time benefits (if you had more than 2 weeks, etc) but since the 'Newco' has limited funds my guess is they are going to do whatever they can to save money to avoid going back into chapter 11 or 7...and a number of troubled companies did exactly that so Eddie wants to avoid that from happening. Either way I don't regret leaving Sears since I am so done with all of this drama. Good luck to all who have weathered the storm. I am also guessing that performance reviews will be handled with a lot more scrutiny that they have in the last few years, a lot of the OKR's were just rubber stamped but now HR probably is going to really focus on performance ... I mean, they have to... in order to get out of the hole everyone has to work that much harder and more is expected of the remaining employees.

You WILL start from zero because you ARE zeroes for sticking around with a loser company when the writing has been on the wall for YEARS
Anyone around when Kmart corporation bought Sears Roebuck and formed sears holdings? The process should be similar I would think?
Not sure how salaries will be calculated. But I can assure you that you will receive a pay cut after you agree to the new contract eventually. The gist of it is that oldsears has to reduce potential unemployment liabilities. Such a mean trick.
