For anybody who has received the offer or welcome letter from BC, does it say anything about severance if we chose to decline the offer?

Any speculation on whether voluntary reject will entitle a severance for spin-off BUs like CB and EUC? My guess is that they may not allow that since there will be no layoffs in these spin-off BUs at the moment.

Rest assured, they have intentionally selected these words. They are legally vague enough that they have a lot of latitude. I would be very cautious with any assumptions of what one will be entitled to when they are, in fact, choosing to resign per the offer terms. This may have implications for eligibility for unemployment, severance package, etc. note the exact severance policy is not given. There is nowhere to ask questions.

People should consult attorneys to understand what they are doing here.

Either you accept the terms and conditions of your offer, or you quit and leave.

Severance is for the people who don't get offers. It's really that simple. Got it?

I wonder if there will be a legal challenge to the severance offer for people “resigning” from the offer of employment.

How do you “resign” from employment you never had?

Not a lawyer, but the offer seems to have too much ambiguity and an unrealistic time for consideration. The fact there is no communication available already makes the terms of consideration… well, decisions are being made under duress.

Thank you for the replies, prima facie sounds like BC is doing the right thing by allowing voluntary resignations and using that slot for a previously blacklisted candidate.

Verbatim from my letter, received on 10/24:
“…if you would like to resign your employment, you may do so within three days of the date of this letter and remain eligible for severance benefits, subject to the terms and conditions of the applicable severance plan. If you would like to resign, you must send an email - from your VMware email address - to resign@broadcom.com. Please be sure to include your full name, VMware employee ID number, and personal email address. If you resign after the date that is three days after the date of this letter, you will not be eligible to receive severance benefits.”

In past acquisitions by Broadcom, there was no severance for those in the US who declined offers.

Some did, some didn't. Read your letter if/when you get it, then you'll know. Su-ks to wait, but that's the only reliable answer.

My understanding (this is not legal advice) is that FT offers may decline and still get severance, transitional offers may not.
