Forget he said, she said. Forget what someone thinks how the WARN act affects someone who gets let go on a second Tues of the week at 2PM if they’ve been with Citi for 2 years, 3 months, 4 days and 3 hours vs the 3rd Monday at 10AM and certainly forget what Citi says.
Each state is different. Contact YOUR state’s WARN department and pose your whatif questions to them. They will answer, at least they did for me for the questions I had for my state. It may take a week to get a response but give it a shot. Go to the source. Stop depending on someone else’s interpretation of how they think it should\could\would play out.

If a company posts an official WARN notice 60/ 90 days ahead of a mass layoff, that’s the WARN period. Do you’re paid for it since you were working for that time period. Once laid off, just whatever severence is paid.

Stop already. You get paid to not work for 90 days. Full pay with benefits. That’s what Citi does instead of posting a WARN in advance.

No. Citi isn’t violating anything. Citi pays employees for the WARN period. You have a non working period of 60 or 90 days ( state specific) where you get your paycheck but don’t have access or work. after that you get severance. So the WARN rules are accounted for, Citi has done this for years.

It seems citi could b fined they didn’t report it to DOL even though they let the employees know

HOW WARN WORKS
The New York State WARN Act requires businesses to give early warning of closing and layoffs. WARN notices DO NOT need to be submitted to DOL from businesses that employ less than 50 full-time employees.

The WARN Act applies to private businesses with 50 or more full-time employees in New York State. It covers:

Closings affecting 25 or more employees
Mass layoffs involving 25 or more full-time employees (if the 25 or more employees make up at least 33% of all the employees at the site)
Mass layoffs involving 250 or more full-time employees
Certain other relocations and covered reductions in work hours
This means that covered businesses must provide all employees with notice 90 days prior to a:

Plant closing
Mass layoff
Relocation
Other covered reduction in work hours

Businesses that do not provide notice may be required to:

Pay back wages and benefits to employees
Pay a civil penalty

I just looked on that website I notice other banks submitted the warn notices to the department of labor. Not sure why citi didn’t? Isn’t this against the law
