WARN -- New York - I only got 30 days????????

The New York State Worker Adjustment and Retraining Notification (WARN) Act requires employers with 50 or more full-time employees to provide at least 90 days of advance notice before mass layoffs, plant closings, or business relocations. This law, which is stricter than the federal WARN Act, ensures employees have time to find new jobs or seek training

@ds as I recall reading, the bulk of the layoffs were in BR. The number of employees affected there would trigger the WARN for them.

So if it is determined that NY WARN was violated, and a class action suit ensues, we waived our rights by signing the 'severance' agreement.

@ds NJ WARN is less restrictive because NJ treats ALL locations as one.

Said differently, it just takes 50 employees anywhere in NJ being laid off to trigger a NJ WARN notice thus requiring the 90 days.

There's a Brooklyn state senator who tried to raise this to the department of labor. Don't know if it went anywhere.

Total workers tied to 2026 effective layoffs from WARN notices: 1,677 employees.

SO why are folks in NJ on payroll till August (90 days) and folks in NY have a last day of 6/7?? (30 days)

Are you sure they didn't hit the 250 since the mass layoffs started?

Triggering Events:
Plant Closing: A temporary or permanent shutdown of a single site.

Mass Layoff: A reduction in force involving 25+ full-time employees at a single site (if they make up at least 33% of the site's workforce) or 250+ full-time employees, regardless of percentage.

I'm sure they didn't hit this number with the layoff in NY.

To the OP - I agree with you. In NY, they can't spli up notices to avoid WARN. The only way they could is if there was an event that triggered the layoff - like a plant fire or they lost a big contract. This is part of an ongoing major announced reduction in force.

In NY, I believe the WARN only gets triggered when the threshold gets hit PER COUNTY. We all live in different counties and so collectively NY Warn doesn't get triggered. F VZ btw. I am sorry you are also hit - I can tell you from experience, in a few days you will only say this was the best that happened to you. Who the F cares about VZ anymore. Let this company go down the sh-t hole.

You were not part of a "mass" layoff, if you wwere RiF'd last week, it was a minor layoff in business terms, thus the 90 days does not apply to you or others, unlike last Nov when 10%+ of the company was affected. This time was under 1%, so follow your pkg terms and move on is the best thing you can do.
