Use PTO before May 28th

Just a reminder to use your floating holiday and consider using some PTO if you have a large balance saved up. Most states only pay out up to 40 hours of unused PTO. If you receive a RIF notice on 5/28, you could lose most of your remaining PTO balance.

@e4 The Company considers PTO to be "granted," which is legally different from it being "earned." Because of that, the Company usually has more control over how PTO is treated upon termination.

In Minnesota, I believe it's standard to pay out unused PTO up to a maximum of 40 hours.

But the "floating holiday" will just be forfeited. So it would be wise to use that first.

@e7 Minnesota does not enforce payout of unused PTO upon termination of employment. It does mandate up to 80 hours of unused PTO can be rolled over to the following year while employed. Makes no sense because you need the payout most when you are unemployed.

There are only about 15 states that pay out PTO, most but not all are blue states.

Minnesota pays out 40 hours only. I lost my 40+ hours carried over from 2025.

If they are rif me they should at least pay out the accured PTOs n carry forwards. How's it legal not to pay what's already accured

@a6 it’s usually the Blue states that pay out. TX does not for example.

Absolutely paid out in Cali, we consider PTO part of severance.

There are multiple states must pay out PTO. I those states are Illinois and California.

I find it interesting that a large amount of supervisors/managers/directors are taking lots of PTO/extended OOO this month.

Also use up all of your FSA $$$ if you have one! You do not have to pay back any of it, even the amount you haven’t had deducted from your paychecks yet.

I struggle with this myself. I’ve been saving PTO for summer, but I know teammates who were cut lost most of theirs. At this point, every month feels like a gamble on whether you’ll be on the list or not.
