Are H1B visa holders untouchable?

Interesting that no H1B visa holders are affected by this round of layoffs. Makes you wonder, are they considered more valuable than the rest of us?

@bv Again not true. RCG means just out of a Bachelors or grad program. PhDs and Masters degrees with patents and papers from top US schools are well qualified for O-1 and still considered RCGs. More over they qualify for the self sponsored EB-1.

How do you know that? Talking to a few H1B holders around you is not a reliable data point. Stop generalizing without concrete data at hand! Otherwise, you just monger rumors.

@bv O-1 is not always considered a dual intent visa. It is assumed but not explicitly. H1-B is the safest option. I was an F-1 under OPT (student with post degree work temporary work authorization). I hold an advanced degree and while O-1 was possible, it was legally more complicated than the H1-B path. I got my green card as EB-2 NIW and due to my degree I could have done EB-1 so O-1 could have been used.

Also Intel has a policy of only hiring H1-B with Masters degree or above which is not considered cheap labor by most world standards

@cv Intel has the fattest group of people I've ever seen, and I've often wondered if that reflected the company printing money for so long that the workers just got used to it.

So they eat out a lot and don't do anything to prepare for the day when the money train stops.

@OP I don’t think H1B’s are untouchable . All the people who got laid off in my team during the last layoff period were H1B immigrants. They are the ones who are more scared than the US citizens. They invested a lot to come to this country. Most of them are PhD folks who worked hard to be where they are now and they contribute a lot. No matter where the company stands right now failing or not, you cannot deny that they are the ones who have a lot to lose if laid off.

The elephant in the room question is "Why does the US have more obese and fat people than any other countries? I see some of these obese Intel worker, and I cringe. How did they get this big. I understand some have medical conditions. US is like Intel, we think we are on top but you need to get the other countries opinion on us.

All of our best engineers are people who are Americans and started as techs, not people with their degrees. It's not a race thing. It's that people who are citizens should be working these jobs. I know many young people who got their degrees, are intelligent, and eager to work but cannot get jobs as engineers because they are taken by people who are a) much worse at their job b) can't communicate well and c) are not citizens.

Why aren't other countries interested in taking care of their own people? Why are they not rooting out poverty and corruption? Why are the people there not making their countries good places to live? Stronger countries everywhere will help everyone.

The truth is that things are getting more and more polarized and things like this (huge companies sc--wing over the people who are citizens) will eventually lead to more extremes behaviors. Most younger people cannot afford homes, families, or any little luxury. Young men especially are getting sc--wed over and this is only a part of it. The damn is going to burst and you may call people hicks or racists or whatever else you prefer but that will not change reality.

The migrants are not the best or brightest. If they were exceptional they would be here on an O-1 visa. Instead they are inexperienced and cheap. As RCGs they couldn't qualify for a visa that is actually based on merit or achievement.

Migrant engineers now make up about 50% of America's engineering position and increasing. Has the increase of migrants been good for Intel? Intel is no longer a leader in innovation and this is the result of a hiring strategy that focuses on young, incompetent but cheaper engineers.

@OP Many H1-B have advanced degrees including masters and PhDs. That can subjectively make them more valuable if it's translating to better performance which hard to judge unless they are your direct reports

@a3 I was an H1-B and did not take any money less than my peers. I applied for green card and citizenship. Got my fair round of promotions like everyone else. Definitely not cheaper than any one else

@aa it's a dual intent visa which means they are elegible to apply for green cards. EB-2 and EB-3 green cards are company sponsored and EB-1 and EB-2 NIW can be self sponsored

@ag Checkout the Microsoft layoff site, they have similar questions. By the way, don't look at the average salary, that doesn't help much. You need to look at the job title, location, year. That's what matters. What someone makes in California for the same position will be different from what they make in Florida due to cost of living.

Here is the website. Since H1B visa gets renewed every three years, the total H1B application approvals can be figured out by adding the past three years total (2024, 2023, 2022). This means Intel has over 11,000 H1B employees (3538+3218+4786).

@ae Compare your salary throughout the years compared to H1B salary for that same year, same position, same location. Then you will see a clear picture. H1Bs make more then you and I. They are no longer considered cheap labor. Now, you are the cheap labor for your company, not H1B folks.
