@LqB3kJG-2pai considering many (can't say all) H1Bs in IT companies are no way "cheaper" than US citizens, and with the hiring committee consistently favoring US citizens, I would say your hostility is a true reflection of your cowardliness...competition carries US this far, without it, your happy little domestic prosperity will be dwarfed by India, China, or even Japan probably within your lifetime.

@qqj, I would consult an actual immigration attorney to be sure, but if you look on the USCIS site [1, 2], it seems pretty clear that the grace period is NOT automatic. Unfortunately, it's not obvious how you can "apply for" utilizing the grace period, which is why it's highly advisable to go to an attorney.

@1qqg for whatever strange reason, I did not receive the package today. The usual contact with BAL attorneys doesn't get through. I have scheduled a meeting with them tomorrow eventually. Will update with more accurate info tomorrow.

The amount of incorrect information and stupidity on this site is amazing to me.

OP - why would you not just call BAL? Their contact information is in your package. They are there to help. They can answer your questions by being experts in the field vs. some idiot on here trolling to get a rise out of people.

@onj yeah, that was before. The new H1B policy has something new, including the 60 grace period. The confusion is, how do we proceed with it or is it automatic.

Wjt - hope it all works out form you! The decent thing for oracle to do would have been to give everybody laid off today the same package. Unfortunately that requires a level of decency that the troika leading oracle is simply incapable of. All the best to you.

My H1B has been revoked due to a layoff. What should I do next?

I have been laid off late October this year by my previous employer without any notice. Since then, I have been actively looking for jobs and networking. Yesterday, I found out my H1B has been revoked by USCIS in the system. Can someone advise me what should I do next? Thanks

You are technically out of status the day your last paycheck was issued. Question is, is your I-94 still valid? If it is not, your stay is illegal - which is worse than being out of status and you should leave as soon as possible.

However, if you are simply out of status - do you think you can get a job offer within next 1 month?

To my knowledge(please double check with an immigration lawyer) USCIS have approved extension for upto 90 days of being out of status. However it depends on case to case basis. In some cases, they may ask you to go to your home country and get your visa stamped from consulate.

I was once in a similar situation and this was my approximate timeline after the last day of my job.

Phone interview - 1 week

On - site interview - 1 week

Accepting offer - 1 week

H1B filed (with premium processing) - 2 weeks

H1B approved - 2 weeks

I was out of status for ~7 weeks.

Fortunately, I was not required to leave the country for stamping and was able to start immediately after H1B approval.

I called USCIS. They don't find any indication that any procedure should be followed. Suggests me to contact Board Protection or Department of States. Since they work in E.T, I can only ask tomorrow.

I had a friend who was laid off with H1B. And he found job at least six months later. He is still OK. The grace period is not that strict, I think. Better consult with immigration lawyers.

I think you should call the visa office and ask what's the steps.
