Retaliatory firing

Anyone been through retaliatory firing? I've been at vmware for 5 years. My manager (who I had for about 6 month) threatened to fire me. I know the reason. It is pure retaliation. What advice is out there? NSBU Palo Alto

Do not expect anything from Employee Relations.
Use conversations with ER as nothing more than a backup tool to document your case, and get external legal advice.

It is bad , it shouldn't have happened with you. Two options

  1. Use company provided attorney services and get information on how to proceed. It's free, if you already subscribed .
  2. Find internal opportunity and then file ETICA too with all the details. They are very much active. These managers are in close circle , if you have right details they are the first one to go down . Hopefully company maintains some ethics.

good luck but I doubt you can do anything. The company has an army of attorneys if you wish to fight it and you have one that you're having to pay for out of your limited pockets.

It is a shame but corporate America has allowed companies to do anything they want. They might be wrong but it would cost so much to prove it that people can't fight it.

Get everything in writing. If you have any discussions with your manager, be sure to confirm this in an email to him/her so there is no question of what's been discussed. BACK UP your emails, data, etc.
EEOC will prep you on getting preliminary detail but do not inform your employer (of course).
Email is king as it relates to employment law. Finally, it may not hurt to get some recommendations on employment attorney's who have done battle with your firm.

Document everything....After 5 years with the company I heard some of that noise too and then 5 months later I was on the RIF list...to nobody's surprise. The managers have way too much power there.

Since it is NSBU where 92% in management are Indian men, I'd say you have no fighting chance to win while in that BU. Move to any another BU except EUC and then file complaint with ER.

If you file a complaint with ETICA you do get whistleblower protection.

Find another team at VMWare or move on. But leave negative feedback for the manager wherever you get a chance.

I know someone who successfully negotiated a package in exchange for resigning, she felt she was being retaliated - they had to pay her severance, allow her to collect unemployment and agree to not disparage her to other companies. She did hire a lawyer. That said, she worked for a small company

Do not report to Etica. This is a tool for managers, directors, and VPs. Be careful. it is a disgusting dirty company with no ethics.

Be careful. Do not report to Etica. Etica is a 3rd party that will end up sending the report to Employee Relations (ER) within VMWare. Then a VMWare employee will pretend they are investigating.

What actually happens is that the ER will communicate with the manager everything. Including your name. You will end up in deeper trouble until you leave on your own. The manager will receive guidance how to ensure you end leaving on your own.

If you want justice, report to EEOC which is a federal agency.

In the mean time, find a better company. Vmware is terminal company with low ethical values.

File complain with ETICA - It works if you have evidence – elps if you can get others to corroborate harassment. Managers and directors. Especially, in NSBU feel they are invincible.
