Thread regarding 2U Inc. layoffs

What's gonna happen if we don't accept the severance package?

Do you think there is a possibility of negotiating (ha ha I loled when I typed this word out)?

Yeah my sense is that the severance package has several unenforceable provisions in it, possibly explicitly to give them something they can magnanimously strike out if you push back/ask for more money. By all means try if you have the slack room in your finances to do so. If you find a lawyer who will work on a percentage of what they can get you, that would probably also be a reasonable move since it risks little over going it alone.

I was thinking about claiming some type of discrimination as on my team only the minorities were let go.

What do you envision you will accomplish by NOT taking the severance? 2U leadership is d-mb and shortsighted but they are smart enough to have crafted a severance package that is likely free of huge legal pitfalls. So, suing them for termination, especially if you are a part-timer in at-will state is a no-go unless again they did something egregiously illegal in terminating you (they likely didn't). As far as any promises about not talking bad about your former employer, I am not entirely sure how enforceable that is (but consult a lawyer if that is a real concern). It is also seriously questionable how long 2U will exist, so any stipulations may be shorter term than you thought. So, losing $500 in an attempt to stick it to them or advocate for your right to bash them might not be worth it. If I were you, I would take their $500 pity money and move on. A bit of real talk: focus on your skills you learned while at 2U and your next gig, don't waste anymore time on a sinking ship.

Past layoff hit here. I spoke with unemployment lawyer over mine and they suggested taking it because unless there were major red flags, it wasn't worth the fight. There's really no negotiation. The company is dying. If you're concerned and want to consider it, look for employment lawyers in your area and do a free consult.
