Thread regarding Union Pacific Corp. layoffs

There is no legal law requiring vaccines

No law was written, therefore it can not be vetoed by congress. There can be no legal accountability for not following directions.

Why is UP mandating this? It is not enforcing the law, it is proceeding at its own recourse. The unions need to force this issue so the company will be accountable in cases with employees may become injured or deceased by getting the vaccine.

You 95% of people who won’t stand up for yourselves can keep this job. I’m out as soon as they tell me I have to leave. If you are pro vax or not this is wrong what they are doing and it doesn’t and won’t stop here. I support 4 kids and have been here 8 years just coming off of a 2 year layoff. I found a job immediately after being laid off and will find another. Until then enjoy your bad ordered locomotives.

The difference between the school vaccines and this covid shot is that the school vaccines work. Does this one? If it does, how come the ones with it are so scared of the ones that don't? I mean, if it works, you can't catch it,carry it,transmit it...oh that's right...it doesn't stop any of those things. Must not work, but take the booster just to be sure.

Actually not all laws are legal. That’s literally why there are 3 separate branches of government including the judicial branch. D-mb a-s

@OP “…legal law…”

Obviously you’ve never attended law school.

The vaccines are safe, effective, and your employer absolutely can require you to get one in order to remain employed. There’s a mountain of case law that supports vaccine mandates issued by private employers.

The only out you have is a religious or health-based exemption, and the burden is on the employee to show why their religion or health condition prevents them from being vaccinated. Your employer can legally ask for evidence of either or both (no, HIPAA doesn’t prevent them from asking).

@3epz 14,000 out of 200,000,000 comes out to. 0.007%. You’ve effectively made the case for getting the vaccine.

Well the last time I checked, there was 14,000 plus cases of break-through cases of covid among the vaccinated. I wonder if the UP has thought of that when they decided to go along with the mandate.

  1. OSHA has no regulatory authority over citizens healthcare.
  1. If OSHA had an ounce of integrity they would forbid mass unproven vaccine on the work force.

Think about this. If I refuse to get the vaccine, I will lose my job. Now, there are millions on welfare and foodstamps and they are NOT required to get the vaccine. Why is this?

U.P.R.R. knows 90% of workers won't stand up for whats right that being said most workers live paycheck to paycheck so almost no one will not do what they tell them to doHell no one even stands up when company forces them to break rules to expedite trains. So you set presidence so go ahead and get vax...

OSHA flip flopped. First said if companies force the vaccination the companies could be liable, not they’ve retracted and will not require companies to record vaccine side effects until at least May 2022. OSHA caved under pressure and so are all these companies… including UP!
Have yet to see this elusive executive order in writing? Not ever shown on any forum, news, outlet, website or anywhere else for that matter. Proof is in the puddin’!
And on your Smallpox comparison… the death rate prior to the vaccine was between 30-35%, remind me again what the death rate is with COVID-19?
Comparing previous vaccine mandates is a dares and you know it!

Not starting a major debate, but here is how this happened.

OSHA has issued an Emergency Temporary Standard (ETS) to impose this mandate.
President Biden also signed an Executive Order that requires this mandate for employees of contactors that do business with the federal government.

Is there a legal precedent for requiring vaccination?

There is, Jacobson v. Massachusetts, [a Supreme Court case from 1905]. The case itself was about a vaccination mandate.
In the early 1900s, smallpox outbreaks were fairly frequent and many people had been vaccinated earlier as children, but needed to be vaccinated as their immunity waned. The state of Massachusetts passed a law that gave authority to local boards of health to make a decision at any given moment in response to an outbreak that smallpox vaccination should be mandatory for all residents of their local area if — in the opinion of the medical experts who were serving on the board — it was necessary to protect the public's health
