SAP sued by SCM AI firm 09


SAP SE was sued by supply-chain artificial intelligence firm o9 Solutions Inc., which claimed three of its former executives stole trade secrets for the European software giant.

In a complaint filed Tuesday in Dallas federal court, o9 claimed the stolen trade secrets concerned the design, implementation and testing of its supply-chain management software. The company, whose backers include KKR & Co. and General Atlantic, was valued in 2023 at $3.7 billion.

According to o9’s suit, longtime market leader SAP was losing customers to competitors in the business-planning software space due to its outdated platform. As a result, SAP allegedly launched an “aggressive campaign” to target o9’s trade secrets. Since the documents were reportedly stolen, o9 claims SAP has altered its software to closely mirror the startup’s offerings.

A representative for SAP declined to comment on the lawsuit.

@2ja Asettlement that includes the acquisition of o9 at a generous premium. Why build it, when you can buy it? SAP has already poached a nice number of o9’s key employees and, o9’s investors could see it as a quick return on their investment.

No one wants to go to court on these things due to the cost and the lengthy timeframes and eepurational damage involved.

SAP just hired another o9 sales leader into a VP of planning role. This entire saga just gets weirder and weirder!

I have a theory about what the potential outcome of this whole thing may be, it’s just conjecture at this point.

@243 Yeah! I also saw him in some SAP - sponsored puff piece. I am Bemused as to why no one has been suspended pending the results of an investigation. It’s a very, very strange way of handling this type of matter.

““SAP is committed to the highest standards of business ethics and respects the intellectual property rights of others,” the company said in statement, “We will review o9’s complaint and will respond, as appropriate, within the legal process.””

@17g Can you pop some extra popcorn for me? This will be interesting to sit back and watch. o9 lost nearly a dozen people to SAP. And several of them are in leadership positions. Personally I think that M. Alam is an ethical guy (he used to be an accountant after all), so this must be eye-opening for him. It will be interesting to see how CK and the rest of the board handle this and what kind of separation agreements they provide if these allegations are indeed true.

09 hired Kirkland & Ellis - an exceptional law firm that charges high hourly rates. That signals that 09 has a solid case - K&E would not consider damaging their reputation filing a spurious claim and 09 is willing to invest in pursuing it. I hope SAP’s outside counsel is advising a quick settlement and lots of firings. Otherwise the discovery part of the case could likely be very damaging. I’ll pop the popcorn. In my experience, I worked with unethical people at SAP - but this takes the cake.

(a) they probably knew how inept SAP’s Ethics & Compliance team has been downsized to. (A RIF-ed investigator is the best investigator to SAP’s people in charge.
(B) since o9 was a niche, boutique player, how much Ethics & Compliance or even IT infrastructure did they have?
(C) Greed - like alcoholism - is an indiscriminant disease and does not limit its prey to high intelligence.

If I were one of the three executives named, I would be worried, especially if they did download files. But really, how d-mb could you be? Are they really that d-mb that they would download 22k files right before leaving the company? Two are CROs for SCM and procurement, another is the CPO for planning (which is what o9 does). They should know better if this is indeed true and it smells of conspiracy.

The amount and timing of downloads, naming files after customer names .....there's no way to spin this that looks innocent. There is a big settlement in SAP's future and lots of firings, to include the potential SAP co-conspirators like Peter G.

Not sure how this would play out in the courts but can't imagine its good for the individuals involved. Out of court settlement with the people involved fired as part of the settlement, my best guess.

@c4 but there could also be some truth to it. The entire Signavio product management comes from Celonis. And they just copied what Celonis was doing. And to copy Celonis, they were all given two promotions in the last 3 years. That claim in the Celonis legal case is 100% legit and this one may also be.

We work for a criminal enterprise full of self-righteous, borderline re--rded psychopaths. About a week ago my sister asked me about the last lawsuit. I think it was posted here. The one where SAP traps customers. She doesn't follow tech at all. I'll have to remind myself how she even heard about it. My bother works in tech but for a smaller company. Talking to him is a breath of fresh air. Not all companies are like this.
