Why the New job postings?

Seriously why post jobs on external sites if they’re meant for internal hires only? Who are you trying to fool here?

You know what @3ude, you’re absolutely right, and I unreservedly apologize for keeping a petty argument going. Stress levels are pretty high for everyone. Besides, the thing most of us on this site have in common is being screwed over by Baker, the last thing we need to do is add to each others misery.

@2nic, Nah, you can do your own homework. To get you started, look up the U.S. Department of Labor MOUs and other regulations. Then you can look at some of the pertinent legal precedents set by the federal appellate courts. It’ll be educational. You may even enjoy it.

I spent most of my time at BH doing other people’s work. I’m not doing yours here.

@2igs, feel free to post links to any of these federal statutes or case law. Presumably those people posting questions and speculating about why BKR is posting job vacancies externally might actually care.

@2kti: There is case law, precedent, and regulations at the federal level stipulating the external posting of jobs. The circumstances under which they apply, and who (if anyone) would enforce them is a different conversation. Your response (from what I read) eludes to this.

I guess you can keep insisting that you’re correct by posting in all-caps and following up with a wall of text if it makes you feel better, or if you think anyone actually cares.

In reply to @2tzp: just want to make it clear there are NO federal statutes requiring private companies to post job openings (either internally or externally).

Companies may decide to develop processes to avoid possible legal criticism. For example, publicly traded companies have a fiduciary responsibility to share holders and may want to establish hiring practices that ensure transparency and avoid accusations of nepotism or self serving at expense of share holders. Companies may also want to avoid accusations of discrimination in the hiring process. To those ends, they will likely develop processes and procedures that follow hiring best practice with regards to posting job vacancies. Of course, once you've established this process, you've got to follow it without exception.

The most likely reason that Baker is posting jobs externally is to ensure they follow their existing procedures and thus avoid claims against them from disgruntled employees (current and former). Nothing more conspiratorial than that.

The job posting is just a joke. They already decided who will take that job. To show as a fair game, they posted on the external website. If you don't know who anyone inside the loop, you are just a stranger. Do you really trust the management? At least, I don't....

@2tzp, only federal laws for hiring contractors for government work, or if you’re specifically targeted for equal opportunity stuff. Companies do have their own policies, however, and it is usually considered best policy to adhere to those policies 100% of the time, or risk law suits from disgruntled employees. Inconsistencies leave room for criticism.

Smoke and mirrors. Recent job posting was just such. One person interviewed and got the job but it was already decided beforehand that this person was getting the role. Waste of time and resources but they have to "appear" to be compliant as close employees were watching what was going on. If you're part of the clique you win. Ability plays (almost) no part in decision making. Got a pulse, don't talk out of the party line, nod your head at the right times and your good.

@1uwx The are statutes governing this, although it’s questionable how enforceable they are and who would enforce them, or if it would even matter if they were enforced.

Unrelated: In my experience, BH management makes a lot of dumb moves followed by sloppy attempts at covering. I can think of at least one example for every week I was there.

Nasty. I saw it too many times. The director’s is pet given the people leader role and no one else really stands a chance but they go through the motions to interview and give the impression that everyone has a fair chance.

Easier to move someone already in the organization to fill in a vacancy than having to onboard someone in from outside. Even if the internal candidate isn’t qualified for the job.

Heck, just look at the managers in their roles. Happens all the time

There are federal labor laws mandating that BH (and every other company) does this. I wouldn’t read too deeply into it.

As for the “more qualified internal candidate” argument, what makes them more qualified? At BH it’s possible to spend months doing little more than sending and reading emails while earning a full paycheck. Besides, anybody who has ever worked for BH knows that qualifications don’t really matter anyway.

Agree. I reached out to the hiring manager about a job posted on the careers website and was told that the job was already filled. But the job posting sat for weeks on the website. You can’t trust the careers website.

If jobs are posting externally, you can bet HR has dictated the situation to be as such! HR wants to fill from the outside, even if more qualified internal individuals apply for them! They influence managers into selecting candidates that they want by using “unwritten rules” to eliminate internal applicants! Some of those “unwritten rules” are job promotions and how recent are they to your applying to the position. Another is distance from your present location to the one you’re applying. These are just a few I was told were used.
