I was under the impression that the system was supposed to be blind. Based on skills, potential and overall contribution with nationality, family status etc. excluded to avoid any discrimination cases....
How this assessment is applied is going to be completely different by each individual....
US law does say that you cannot replace full-time employees with visa temps. However, you can layoff US residents without getting rid of current Visa holders. Fact.
If you are American in Schlumberger, you have no career, you are the first target to be cut, and you will likely NEVER see an executive position. This is fact. And pray you never get acquired by them.

I say in this economy sending the illegals and H1B visa holders back to their countries is one of the solutions and I definitely vote for him. The Indians invaded all the spheres of the US economy except jurisprudence not because they are smarter but only because of the ability to speak English better than all other non-English speaking immigrants and because they are tricky and manipulative. They strive on the others' weaknesses. Send'em home first. Th Chinese here do actually work without spreading the sh-- around.
It is not only H1-B visa, but also include L1-B visa. SLB uses L1-B to transfer people from China, India, ... to US to replace US worker. The spouses of those L1-B visa holders even get the work permit to work in US.
Obviously visa holders would be retained. Otherwise they will have to pay relocation expenses for entire family! Some insight I got from HR..
Vote for Trump! These H1B cheap labour folks take our jobs away! They send their money home back to India or somewhere else where they buy real estate and collect non-taxable income for lending these properties. Whilst I struggle here to make my house payment and keep some food on the table. This is a f---en nonsence! And now this f---ing healthcare penalty. I am an American who used to work at MI Swaco. I confirm and herein attest that this particular SLB segment, especially in their departments managed by the UK managers, would terminate US citizens first, and non-whites Americans among the first ones. They, however, would retain East Indians (Asian Indians) in exchange for tangent and non-tangent benefits. Unfortunately, these managers are still there despite overwhelming evidence of such deeds.

WASHINGTON, DC: When it comes to increasing skilled workers on H-1B visas, one could say presidential candidate Ted Cruz is a bit of a black sheep amongst the GOP.
The Republican presidential candidate wants to increase the H-1B visas by 500 percent from its 65,000 to 325,000.
Cruz, who announced his run for the Oval office this morning, had made the proposition in 2013 as an amendment to the Senate’s comprehensive immigration bill.
While the Senate’s Judiciary Committee torpedoed Cruz’s amendment, they did approve an increase of 180,000 in the H-1B cap, but the House never acted on the legislation.
It’s not clear if Cruz had only the base 65,000 H-1B visas for skilled workers from around the globe to emigrate to the US in mind, and he didn’t want to include the 20,000 other H-1B visas which are allocated especially for students who graduate from universities in the US.
However, Cruz’s amendment proposed drastically increasing the fees associated with the visa applications from $1,500 to $2,500 for companies with 25 H-1B workers or more. According to Computerworld, the additional revenue would be directed towards promotion of STEM education.
Cruz is one of the few right-wing politicians who subscribes to the same school of thought as his Democratic opponents across the party aisle, in believing visa workers in the U.S. provide the catalyst for further domestic job growth.

A company that large and that well organized will not, as a general rule, make large scale legal mistakes. You are much better off focusing your discontent on finding a different job instead of trying to take down the company you work for.
I have been in similar situations before where I hated the company I worked for and its owner. I was so much happier when I put it all behind me and moved on to a new job. The same would likely be true for you too.

We graduate two times more Americans with STEM degrees each year than find STEM jobs, yet as much as two-thirds of entry-level hiring for IT jobs is accomplished through the H-1B program. More than half of H-1B visas are issued for the program's lowest allowable wage level, and more than eighty percent for its bottom two. Raising the prevailing wage paid to H-1Bs will force companies to give these coveted entry-level jobs to the existing domestic pool of unemployed native and immigrant workers in the U.S., instead of flying in cheaper workers from overseas. This will improve the number of black, Hispanic and female workers in Silicon Valley who have been passed over in favor of the H-1B program. Mark Zuckerberg’s personal Senator, Marco Rubio, has a bill to triple H-1Bs that would decimate women and minorities.
Requirement to hire American workers first. Too many visas, like the H-1B, have no such requirement. In the year 2015, with 92 million Americans outside the workforce and incomes collapsing, we need companies to hire from the domestic pool of unemployed. Petitions for workers should be mailed to the unemployment office, not USCIS.
