Severance lawsuit needed?

If you are laid off and you are to get the severance+WARN yada…yada…and as I have seen on this board, Citi dragging their feet on the payouts…. I assume its to encourage you to take just any job at all, which in turn stops the severance+WARN payouts, which by the way never took place.

Could you sue Citi after the fact for dragging their feet+stress+punitive damages?
and if you could….
Would it be best to cash in part of your 401K to live off of, then sue Citi for dragging their feet+the 401K cashin+taxes you pay on it+stress\punitive damages?

Does anyone have any or seen any such experience of this?

absolutely no one from Citi is dragging their feet whatsoever. The “not getting any money” for months, its just all a figment of your imagination.

After when you left Citi HR said “We’ll take care of it all” and gave you an official thumbs up gesture as you walked out of the door. So you see, all is well.

You get WARN payout ( if qualified) for 60 or 90 days, depending on your state. While on WARN you are still a Citi employee, so you shouldn’t get another job during that period, or you could stop getting WARN and be disqualified from severance, since then you actually quit Citi. ( May or may not be enforced). After WARN you get Severence as a lump sum, you can get a job anywhere but Citi and keep your Severence.

Upon any such happenings by Citi, might I suggest hiring a lawyer on contingency.
The lawyer does not get paid unless you win. Sue for severance+legal fees+punitive damages of stress and the waste of your time on chasing down your severance.

Wait, I thought those affected remain on payroll during WARN then lump sum severance based on years served or pay band after the WARN period has ended? Can someone confirm?

Don’t you get severance regardless if you get a new job? Unemployment a different thing and they may be doing this to get out of paying unemployment

If you got a new offer elsewhere then take the job and just log in with the new job once a day. I wouldn’t tell Citi. It is none of their business. I know of a few people who got laid off this past round and haven’t been working.
