The following practices constitute age discrimination
- Requiring workers to retire once they reach a certain age
- Treating older workers worse than younger workers, by, for example, targeting them for layoff or discipline
- Giving younger workers higher pay or more favorable work assignments
- Making decisions, based on stereotypes about older people (for example, refusing to include older workers in training program because of a belief they are unwilling or unable to learn new things)
If any of these things have happened to you, you may file a charge of discrimination with the Federal Equal Employment Opportunity Commission (EEOC).
You may also file a lawsuit for age discrimination. However, the employee must first file a charge discrimination with the EEOC to get a “right to sue” letter.
