If your company policy includes severance language, then yes they will have to pay. Typically, employees covered under a collective bargaining agreement will have to demand and negotiate severance. Most states in the USA to not require employers to offer them. Usually it is in the best interest of a company to offer it though. Twist their arm a bit. They probably do not want employees to quit prematurely. Nor do the want a bitter unproductive workforce. If you are a Union employee, organize your members now! Demand your Locals to get severance package proposals on the bargaining table. If the company wont bargain, take a strike vote and shut down. What do you have to lose when all is lost? Many companies including union shops, will give a comprehensive severance package based on years of service. Its the right thing to do. Good luck.
