Suing SAP for discrimination on VERP based on age

Wondering if there could be lawsuits against SAP for discriminating offering VERP based on different ages.

In the U.S, VERP is offered to those 59 and above, in Canada it's 58 and above and

in Germany it's 55 and above.

Would these lawsuits hold water in courts?

In the US, age 59 is the age because this ties to the age when individuals can pull funds from their retirement accounts. I doubt a lawsuit of this nature would have any legs. As long as the age requirements are consistent within a given country, there is no discrimination. This is why there are no exceptions to the age requirement. For example, if you turn 59 on Jan 1, 2020, you can't get the VERP even though you miss the cutoff by one day.
