Severance?! they can barely make payroll, I hope I’m wrong, but if the past year has taught you ANYthing, do NOT plan on notice, let alone severance
You people don’t get it they are not paying severances and even with the warn act you may be working still cleaning! Run as fast as you can stop trying to figure out what they are going to do! They are going to use you till the very end! The writing is on the wall and you will be much happier going somewhere else!
If they shut down, and are in the midst of restructuring through bankruptcy, they don’t have to pay a dime of severance. Severance is a luxury/benefit, not a legally binding pay requirement.
I'm pretty sure it covers closers as well.

Warn only applies to layoffs, legally no notice or severance required if they close the doors
-sgk: are they breaking the law then? If so, where, in PA?
According to the WARN notice they do unless you were notified that you would lose your job in 2 months
The Employee Handbook, which was last "Revised October 2007", is on the HR One Connect website. The policy is on page 89 of the file (The document of course was not re-paginated so it shows page 85 on the Table of Contents). Policy reads:
Severance Pay
No employee shall be entitled to severance pay upon leaving the Company simply as a reward for service. The company, at its sole discretion, may pay severance to a departing employee only when the departing employee has signed a severance agreement generally releasing the company from all claims that the employee may have against the company. If the Company chooses to pay an employee in lieu of notice, the employee will remain an employee until their termination date and thereby is subject to all Company policies and guidelines.
So the only way that would do it is to protect themselves from legal risk.
Where did you see that?
