I was one of the employees who took the the pension package. However, I did not decide when to leave. I applied for employment benefits and was not bale to receive it because they stated it was voluntary. I have heard that same of the employees did receive it. I do not see how the is fair to all termed employees.

VERP is a good acronym but can be a forced choice. I was told that my position was being eliminated so retirement was not so much "voluntary". That said, check the 3rd letter in VERP. R stands for retirement. How can you file for unemployment if you are retired. I believe you need to be available and seeking employment in order to qualify for unemployment. I suspect that this was true for a number of people.
Forced "voluntary" retirement is a force out. NYS would probably give you UE benefits.
Some took the VERP knowing their homeshored positions were being eliminated in the near future. Seeing colleagues being laidoff and then replaced by new employees in Super Center locations was a glimpse into the future. An argument can be made that taking VERP was a forced decision. I also heard of managers pushing some 55+ to take it as though they had advanced knowledge of what was to come for these associates. All these are factors to be shared if you apply for unemployment. ADP can contest it but a determination for eligibility is made by the EDD in each state
I'm surprised ADP isn't fighting / contesting (they still may...) When you applied for unemployment what did you list as cause for termination? Did you state it was an accepted VERP, or did you say office closure, layoff etc?

Retiring by choice should not get you unemployment Bennie's. Work the system. Go get a temp job and then stop. You should be able to get Bennie's then.
Anyone that accepted the VERP is not eligible for unemployment benefits legally. Cali. would be the only possible exception because of their nonsensical government but I doubt it even for them it’s probably a Federal issue.
are you saying you took the early retirement offering? Voluntary was stated a million times in the paperwork... I am not aware of any state that provides unemployment compensation to anyone who leave their job voluntarily.
determination of unemployment benefits is made by the state. Not all states have the same rules.
