They're contacting current employees too. Stench of desperation.

If you put your profile on linkedin, you will most likely get contacted. You can also reach out to contracting companies. ADP is working thru these agencies, they won't contract with the employee directly. Some companies pay 1099 and some pay W2.

There was nothing in the ERP about this, but I have heard it is happening. The 6 mos rule is protecting ADP, so that they can legally reclassify an employee as a private contractor. There could be real labor law issues for ADP if it was viewed as what it really is.. terminating (by layoff or ERP) an employee to bring them back and no longer offer benefits, over time or pay employer taxes on them.

I took the VERP and don’t recall anything documented in the package about returning as a contractor. Can you provide some more detail about where this info is coming from? I would not be opposed to going back if I was contacted. Thanks

Per the verp you have to gone 6 months if they want to call you to be a contract employee. Which means you are a 1099 Employee so ADP does not have to pay any taxes for you. Normally contract employees are paid more then when they were employees of ADP. It can also last for some time.

I was not called after I was laid off (not VERPed), but I knew that some of my colleagues were. Not many, and the gigs didn't last long. I think that ADP is holding its nose as it does this to try to temporarily shore up its knowledge base.
