UK Layoffs - The Law

Ok,

In the UK there is strict laws around making people redundant, if like lots of speculation BC will hit us hard, then they will need to follow that law of the country concerned.

For the UK this is

Number of proposed redundancies

20 to 99 30 days before the first redundancy

100 or more 45 days before the first redundancy

Based on that, BC cant kick people out the door on Nov 5th unless they are making less than 99 people redundant. 30 days will be Oct 6th.

The most likely scenario is that BC will announce things on Nov 6th and we will have layoffs happening 45 days after. If the numbers / percentages stack up.

Just as likely that BC announce new jobs / roles / salary's for all on Nov 6th and we all KBO.

I think Broadcom will do better than than the statutory minimum, but nonetheless I expect a bloodbath. If UK employees think that the clock doesn’t start ticking until 30 or 45 days post close I think they will be surprised.

Worth adding, before everybody starts paying of mortgages, that in the UK statutory redundancy payments are capped at £508 week. (Assuming you ern over £26,416 PA

Also Total overall payments are capped at £15,240 (If using statutory rules).

Companies making you redundant have to pay the above as minimum, any more is at at the companies discretion.

Mean responses or not gardening leave can be provided concurrent with notice. And I do agree with the other poster that Ditton Park will be dramatically reduced in headcount.

@VmtlvHE-1zpjv- you come across as such a d--k with that last comment. There's a lot of good hard working people with families in the UK office who are going to lose their jobs, not all of them are well paid earners either compared to the US.

There's sh-- employees who think they are the nuts all over the world but the OP is true that we have better employment laws than the US - you should also check out the French as well because they are heavily in the employees favour.

The UK will have to give 30-45 days notice, they can't just drop kick your a-- like they do in the US.

You are right tho, in that Ditton Park is about to get decimated and the funny thing is most people want out anyway so good luck to all of them

Such a UK response. "You can't do this to us, we're British and have different laws".

The office will be GUTTED. You may get gardening leave in exchange for notification, or just severance.

But don't think you're special. This was the problem all along with Ditton Park prima donnas.

They will just put UK employees on “gardening leave”. Where you may be required to work/may not at their discretion.

Not too shabby as it will give 30/45 days of pay (plus severance etc) so you can relax or look for another role.

Yup, it’s similar in other EU based countries. In CZ (relevant for Prague office) it’s two months of termination period (starting from beginning of following month) plus guaranteed (by labor law) severance up to 3 monthly salaries (based on your time spent in CA: 1 year and less = 1 salary; 1-2 years = 2 salaries; 2+ years = 3 salaries). So even if we will be notified on Nov 5th it means that you will get at least your salary for Nov and 2 salaries for termination period (Dec, Jan) plus guaranteed severance (additional 1-3 salaries). They can’t simple fire us on day 1 (this is possible only if you agree with this).

Unfortunately for our US colleagues the labor law in US is weak. And even if WARN act is triggered it’s still not enough. Not considering current labor market and structure of jobs which will be most likely cut off. It will hit US folks much harder than us (in EU).
