Thread regarding Sears layoffs

What happens to people that are currently in workman’s comp?

Will they continue to get paid or will they be cut off?

Sears Re has not filed for bankruptcy and it is my understanding that you would be paid. I could be wrong though but read the bankruptcy docs pertaining to Sears Re. You're home right? ;)

It's very likely that Sears self-insures for workman's comp, since they self-insure for stores, and other necessities. Since it is also likely that the company will end up in chapter 7, then the workman's comp plans would end. If your payments terminate, then you can file as an unsecured creditor, but the odds of recovery are slim, and it may take a very long time for those claims to be processed.

Worker comp is basically an insurance benefit that is provided so you dont sue employer for injuries - if cutoff it would seem logical that you would be able to initiate a suit to recover compensation

Lotsa luck with that

But hey, give it shot and sue for billions and if win you can re-open a shuttered Sears
