Workers kept during the transition will still get severance?

There's some misinformation on this thread. Well there's misinformation almost every thread but as far as this one goes- anyone kept during the transition will still get severance when they are released around the middle of next year, they'll still get their stock options, etc. Nothing changes except they get another 8 months or so of employment and they'll have a much better idea of when their termination date will be- which makes it somewhat easier to look for a new job as compared to not really knowing if they will kept on in another 2 weeks. Besides, in many cases it's not up to the employee if they're chosen for transition- if they refuse, it's no different than quitting and goodbye severance, stock, unemployment.

I didn't know this. Can anybody confirm if this is true? Btw, this is a post from another thread on the CA board.

More misinformation (I'm the one who posted that there's misinformation).

If you are offered a transition job and you refuse it is the same thing as quitting and you will lose stock and severance. Doesn't matter if the job is "markedly different". What might matter is if there would be a geographic shift of more than ~60 miles (this may vary by location) in which case you might have grounds to refuse and you'd still get your severance and stock and all of that.

Other than that, if you refuse the transition job or quit you get nothing, including unemployment.

If you accept the transition job you will get all of that plus more time to find a job.

Outside of America? Who cares? I assume you're from Europe. If you ever wondered why America is kicking your butts economically just look at your ridiculous labor laws. Who wants to do business in a country where you can't control the size of your own labor force?

Why on earth would Broadcom offer you a transition role that is substantially different than what you already do? They won't.

If you're offered a transition role it means you'll be teaching someone else how to do your job so they can replace you with someone cheaper. They're not going to ask Sales guys to work in development or support guys to work in HR or anything dumb like that.

The last comment does not make sense to people outside of America . If the scope of the transition role is different to the current role then you very much are in control to decline and force redundancy (term) options . Anyone who advises otherwise is lacking generosity with the truth.

This is not true. If you decline transition it's the same as resigning. No severance.

You can decline transition and get a severance. If you work the entire transition, there is a bonus. If you quit during the transition, you quit and will not receive severance or bonus.

If a transition is offered and refused, but is different in scope to the prior role done by the individual then I would think you have a legitimate case that you could pursue depending on your geography. The pretense of a forced approach of either taking transition or else doesn't quite cut it and should be looked at case by case.
