Has anyone ever challenged the non compete? Hard to tell if it's anything more than just a scare tactic

i was told that u can break the non compeate but by doing so u give up your remaining severence upon hire

Non-competes can be tricky. i suggest you see an attorney. Often unreasonable terms in the non-compete can be subject to a null-and void ruling, and you may have a foothold if you can claim hardship.
Generally speaking, if you are going to seek employment in a similar industry within the specified time frame, you are subject to the non-compete contract.
