Severance - are people getting different things ? Need to consult with attorney

I think it is important to share what it is looking like for everybody. I’ve seen different answers to this question. I have a meeting with an attorney and want to collect as much info as I can

I was let go in the first wave and received 1 week of severance for every year I had worked for EDMC or DC. Mine was 6 weeks as i was with Ai for 6 years. I needed the cash so I signed the document willingly. An attorney friend of mine said holding out for more would be a waist of time and if they declare bankruptcy, I might not even get that.

In Illinois you collect severance and unemployment at the same time because severance is not considered wages. PERIOD

You cannot collect unemployment until after your # of weeks end. You also only receive benefits until the last day of the month. You do have the option to sign up for COBRA, but it is expensive. I was laid off in April and have already been through the process.

We need to start including state and title. IL and FL are warn states but severance, warn and titles aren't consistent. Withholding pay hoping everyone blindly signs. People that always drank the koolaid are now seeing the light of deception. I only hope that they too are sitting down with an attorney.

There might be a case based on people’s particular situation and the state they are in. If anything if enough pressure is applied they might cave in. Just submitting to dceh is not an option for me after spending my career at one of these locations

You file for unemployment from the day you stop working not when your severance ends. You collect your severance also. You simply mark that you worked zero hours but still claim the income.

I’m in a WARN Act situation: July 27th is my last day, will get paid through September 11th (as letter states). From my HR’s understanding I will have benefits through September and will continue to accumulate PTO through the 11th for which I will be paid.

Does anyone know if I can collect unemployment starting in July, or would I have to wait until September?

If you live in a WARN state AND have more than a certain number of employees (many AIs do not) then you will get a 60 notice that will either count as severance OR they can make you work through it meaning zero severance (faculty will be screwed) if you don't qualify for WARN then they don't have to give you sh--. They MIGHT give you a little. An attorney can't help you with that.
