Just because you can sue, doesn't mean you should

Today anyone can sue for anything. But just because you can doesn’t mean you should.

To sue ADP for age discrimination would be a huge waste of money and time because you won’t win.

All of these layoffs are carefully planned and thought out. Each time a layoff is done a list goes out to those affected and they always include people of various ages and job titles so they are not targeting in specific group. There is an entire legal department armed with a bunch of smart lawyers ready to jump on any lawsuits that are filed.

The last thing to mention is when you get layed off in order to get any severance package they are offering you need to sign a waiver that says you will not sue for any reason either now or in the future.

The only real reason the "Voluntary ERP" was offered was to avoid a class action suit. That age range of employees were bound to be terminated, this just mitigated the loss for adp. It also gave them a tax cut so win/win for them.

The subject of this thread is about suing ADP for age discrimination. Both the severance and ERP packages are mentioned. Bottom line is in my opinion no one will win if that sue regardless of whether they were layed off or took the ERP.

The previous poster is not correct about unemployment for those who took the ERP. I know several folks who got approved and are collecting.

This thread is talking about two different topics. One is a layoff package which companies are not required to offer when downsizing. The other is the retirement package discussed in other threads. The retirement package was voluntary and severance is not offered with retirement, nor is the ability to receive state unemployment or job assistance towards your next position.

It’s not as simple as you make it sound. Actually you sound somewhat neive. Some on this site were talking about suing for age discrimination. Yes it was voluntary but many felt pressured to take it due to fear of being layed off or managed out. This is a valid concern. In my opinion no one will win that type of lawsuit but if someone feel that’s what they need to do then more power to them. Just because ADP made it voluntary doesn’t mean everyone is agreement with the way it was presented.

why would you want to sue them? It was voluntary and you did not have to take it. I did take it and it was a generous offer. I do not agree with many things ADP does but voluntary early retirement offers are happening everywhere. This is the way it is.

If you don’t sign the waiver you don’t get any severance oackage. Yes you can then sue but I don’t know many people who can really afford to do that. And if you decide to sue well good luck with that!

The waiver that is signed by the laid off employee to not sue ADP would be laughed out of court by a judge. That waiver is not enforceable. Although the severance payments for the employee could be stopped by ADP for that reason, or no reason. ADP is not obligated to provide any form of severance for any employees it lays off.

But ADP is doing a good job of killing itself in eliminating its knowledge base by getting rid of its "expensive" experienced workers. Pretty soon there won't be a company to sue.
