If they decide to claim bankruptcy that clears them of the WARN act. There are ways around the Warn Act. They sent letters out prematurely and were warned of the problems after the fact, that's why they retracted the letters.
Oh, theres definitely no severance. These scumbags are trying to cut their losses. They are on the hook with regional accreditors, Dept of Ed and the IRS. And if you are under the impression that dceh is paying you for 60 days it seems that might not be the case either. Thats why they are retracting the first letter. They are trying to say we aren't closing so therefore we don't have to adhere to the WARN act. They aren't even teaching out the continuing students.
Businesses fail every day, I get that but as a longtime employee of AI its sad to see the schools go down like this. Without integrity or any sense of moral obligation to its most important shareholders - the students! Shame on them.
So it looks like dceh is violating the warn act. As far as we know at least 2 AI closure campuses haven't received any notification regarding their last day of employment. All the warn filings that have been posted on this site state clearly dceh filed as campus 'closures' and the last day of employment is Aug 28th. i'm not sure why they are trying to retract that at this point when we have the proof! Some campuses received both letters, some only the first letter and some no correspondence at all.
any conflicting info to this would be appreciated.
With a WARN notice don't expect a severance package depending on what state you work in. Severances are up to the company, it is not guarantee. Many companies do it because it is the right thing to do but after a 60 day notice the company has fulfilled its obligations.
