Thread regarding Staples Inc. layoffs

Has anyone negotiated severance?

I was terminated while on FMLA. I was on FMLA because Staples would not make a reasonable ADA and Domestic Violence safety accommodation. Even with a stalking protection order and medical paperwork, so I was pushed out on a leave of absence- I had no choice.

Now they've cut me, they want me to sign this paperwork saying I won't sue them. Under every ADA law and Domestic Violence statue in Washington State, says that management broke the law, not accommodating my disability (PTSD). The only accommodation was to have a private place away from the front door (there were 8 vacant offices), and it was denied. So I was unable to work.

Should I sign the severance or file suit?

Can you tell me more about the 2 year litigation you had with them? Is there a case number I can look up?

The sales manager was emailed from me, THIS IS AN ADA REQUEST. Management had a copy of the protection order. The sales manager came back- Denied, you cant have a private office. (yet, 8 were vacant, and my job allows me to have an office). She didn't go to HR, or my manager, who had the court protection order and medical paperwork. She just said, nope, you can't and ignored my words in the email that said "ADA." ADA is actually Federal Law, not just WA State, amazing. This new company is getting a handful from me.

Thanks! Lawyers say I have a case, I've already sent them summons, just haven't filed in courts, they have 20 days to respond, then I'll file. The law is the law. I would love the court to order the sales manager that denied my ADA request, to volunteer at a domestic violence agency, so she can see how real, her ego-inflated, decision was, and that DV survivors are suffering everyday, trying to survive and get back on their feet, working is that much harder for DV survivors, Staples doesn't need to make it harder. I should have the civil human right, not to be forced to sit at Staples front door, when I have a stalking protection order, and a crazy man is literally hunting me down. I asked for YEARS to move away from the front desk, and it was denied. Then I was told, I could move to Portland SBA, and I did, and Staples did an about face, and denied it after I signed an apartment lease, etc. I didn't ask for a crazy man to stalk me. Who gives Staples the right to decide what I do and don't need for my trauma. I just wanted a safe quiet place to work. They made it all about ego.

2 years of litigation..... but you do have a case.

Please get advice from a lawyer, you may have a case. In most cases, lawyers will have a free consultation to hear if you have a viable case.

Staples management chooses to be ignorant of WA law. They routinely broke contractor laws while I was there.

I imagine thats yet another "unknown" issue sprung on the new owners.
