I got let go for admitting I returned computer items from over 3 years prior. Repurchased but eBay goes back only 3 years and PayPal 2 years. Don't think it would of mattered even if I could get them. If you are called into investigation by internal director, I highly recommend you say nothing and tell them you want to discuss with your legal council. you may be let go any way but at least you can force their hand. They may have got records from the stores without your consent which is better to show if it goes to court.

There’s really not any way to go after the vendors that disclosed my personal return details to fidelity. I’ve been researching and found this buried in their company privacy policy.
It may be necessary − by law, legal process, litigation, and/or requests from public and governmental authorities within or outside your country of residence − for Apple to disclose your personal information. We may also disclose information about you if we determine that for purposes of national security, law enforcement, or other issues of public importance, disclosure is necessary or appropriate.
We may also disclose information about you if we determine that disclosure is reasonably necessary to enforce our terms and conditions or protect our operations or users. Additionally, in the event of a reorganization, merger, or sale we may transfer any and all personal information we collect to the relevant third party.
My guess is that Apple interpreted the purchase and return as a threat to their operations or something.
Ughh
Is the wave moving from the phone sites to the branches? No doubt it is much more efficient to hit phone sites first due to the concentration of employees and no travel needed for corporate security folks. If rumors are true re: Cincy branch then it makes sense that branches near phone sites are being hit first. Security can't do this in every branch in the country simultaneously so they have to start somewhere. But the legal need to treat everyone in the same boat equally means that all will be hit eventually.

None of the blogs talk about anyone taking any legal action.
what's the other blog this is being talked about? i would be curious to read that too. can you provide link?
How do you know that people aren’t taking legal action? It’s not usually wise to comment in a public forum about ongoing legal matters. Your attitude is poor and you don’t belong in this conversation. Take your non contributing banter elsewhere.
If most folks got fired is due to just a mistake and if they are innocent then why they are not taking any action? There is no details on anyone taking any legal action against Fidelity Apple and Bestbuy. Looks like many thieves are still working at Fidelity as Fidelity is continuing the firing and ruining their lives. It’s not safe to do business with Fidelity as the company is full of unethical thieves. Looks like there are thousands of thieves still working with Fidelity and people should take all their money out of Fidelity and invest somewhere else. Their money is NOT SAFE with Fidelity.
Three people were let go. Fidelity more than likely hit the brake to see post wsj article backlash. They now realize nothing is being done by those fired and will now proceed.
Three from Cincinnati got fired this week?
After About a month of silence... Last confirmed firing was may 11th.
If you aware of Cincinnati firing, please confirm the date and count of firings
If you know of firing at an other location, please inform this group
3 employees in the Cincinnati branch
Who got fired from where?
The Witch Hunt continues ... Special place in hell for the lemons that "lead" Fidelity.
So how many got fired this week? I read on another blog that a few got fired last week? Is this true?
I still don’t see Fidelity has taken any action on correcting their own policy. Many people are looking for job outside. Fidelity does not care for people anymore. Company is full of unhappy people.
On top of Fidelity violating employees’ privacy with return receipt collection, they also have taken private information on calls into WageWorks by employees that were let go. Did you call WageWorks to see if your rash cream would be covered with your FSA? Now Fidelity knows you have a rash. You get the point. I find it hard to believe that this collection of information does not violate HIPAA privacy. That would be a serious offense.
I was let go in April. I was in a six figure role. My clients were my life. Was let go under similar circumstances as most here.
Since then I have successfully collected $275 unemployment each week. Yay.
I pay $670 a month for cobra health coverage because I have a family to support and we have already met deducts etc. killing me!
Applied for almost 200 jobs since then. Only 50 or so are jobs I really want. Have received 60-80 denials and gone on 6 first interviews and a few second and third interviews. Waiting on the rest. Still no job.
Pretty crappy situation. Degree in finance. Minor in Econ. Fully licensed. CFP. I feel like my life was unnecessarily ruined.
I will forever hate fidelity for how they handled this. I am in Florida so a wrongful termination suit is out of the question.
I’m just shocked that Adrian would orchestrate something like this.
Thanks you b--ch.
I’ve been denied at least 20 positions from this ordeal. I did absolutely nothing wrong and was still terminated by fidelity after proving there was no “fraud “. I hate to read these stories because good people were hurt for no reason. Im sure some people abused the program, but I don’t think hundreds of people did.
Which lawyer took it on contingency? And what are they fighting for? I was affected back in October and still haven’t found work. No unemployment either. I’m at witts end!
How do we join the class action?
I am. This is wrongful termination through and through. Lawyer took the case on contingency.
So no one is taking any legal action against Fidelity? Anyone?
They contested unemployment for you? They didn’t contest mine at all. I am in Florida and they allowed me to collect. I’ve been getting $1100 a month since I was fired.
You'll actually get a corrected W2 if you pay it back. Speaking from experience.
Stop the madness. Seriously, enough is enough. P.S. the $ through the reimbursement program was taxed, so are they accounting for that?
Received a nice letter from Fidelity today requesting that I pay back the “overpayment.”
So for me and many others (those who exchanged a computer several years ago with no ill intent), this is what we get:
-Fired without warning and for a BS reason
-U5 filed which makes it nearly impossible to get another job as a registered rep
-Have to comply with FINRA investigation or be barred
-Have to appeal unemployment disqualification because Fidelity fought it and said we aren’t able to collect
-Intimidated by this repayment letter despite following the rules of the reimbursement program and not violating any written policy
F--- you Fidelity
Profit sharing stopped for any paychecks paid after termination date, even if money was earned prior to termination. Unused vacation days were paid out.
For anyone who got let go due to the reimbursement situation, I'm assuming you received no Profit Sharing pro-rated payment if you were somehow over 1000 hours for the year, however, did you get compensated for your unused paid time off days?
You obviously haven’t spoken to her. She can’t help
Doubt that. Spamming and trolling is not allowed here, any suspicious multiple posting gets nuked by site admins.
This Neda Atae lady is making half these comments. Just another lawyer looking for work.....there is really nothing we can do.
the attorney I mentioned, Neda Ataie, is collecting names & numbers of employees who have been affected by the reimbursement program for a consolidated legal action against Fidelity. She will give you more info, give her a call at (800) 797-9888 or (760) 720-9600.
Only if you ever want to work in the industry again.
I just received a FINRA inquiry letter but I am not registered with FINRA nor have never held a securities license. Do I have to respond to this?
100% the decision to fire is made prior to being interviewed. To the person that missed the Black Friday deal, you are lucky, because you certainly would have been fired over it.
Only the people that set this witch hunt in motion know the true corporate intentions behind it. Fidelity will probably get away with all these firing with little to no recourse, and in the process ruin the careers of a lot of good people over something so insignificant. Fidelity can spin it anyway they want, but they don’t give a rat’s @ss about their employees or their future. Only their bottom line matters.
So much authority bias on this forum. Fidelity never performed actual investigations. They seen someone returned an item and asked no further questions. Investigators aren’t there to sort out truth, but rather for future defense they felt they would face in court once smoke settled. Decision was made to fire individuals before investigators arrived. There interview is done for damage control.
As a current employee with nothing to hide, although that’s more by chance than anything, I am somewhat dismayed by this message board. For me I bought a 1200 dollar computer back in fall 2015. Black Friday came around and it was 979. I tried to exchange but was past the return time period. I would have done that in a heartbeat and the last thing I would have thought about is the 43/44 dollar overpayment from Fidelity had the exchange gone through. Who gives a s**t? The answer is neither me or Fidelity. They would only care now as a way to get out of severance. But fortunately for me, I wasn’t able to exchange...I just overpaid by a couple hundred instead.
Here’s my issue with this board. I’m afraid that a great majority of the “200” let go are not posting. They either don’t want to speak out or are just oblivious. Anybody in the regional centers knows that a good amount of coworkers are just coasting along and this is really just another phone job to them. And if they lost it, oh well on to the next thing. Then there’s Portfolio Specialists, RRMs, and others who literally got their hearts ripped out because of this incredulous witch hunt.
I wish there was unity. The media don’t seem to care. Attorneys seem to be focused on U5 language which still won’t matter. The termination alone will cause many firms to steer clear. Unfortunately, the fight might be over.
am I wrong in thinking that the entire point of reimbursement programs is for a business tax reduction? Is Fidelity adjusting its tax records every time an over payment is received? Plus aren’t these still “allegations of over payment” or does Fidelity become judge and jury once they take away your badge?
No way. Send the over payment notice back with a request of proof of the over payment. Tell them they sent in error and no payment will be sent without proof. The won't send you what they have if anything.
You either pay it or they send it to collections and it busts up your credit history. Not much of a choice.
How this attorney Neda is helping affected folks? Are they taking any legal action against Fidelity/ Apple/Best Buy?
Fidelity actually had the audacity to send me a bill for the reimbursement after they fired me. What are my options here?
Neda Ataie. Her phone number is (800) 797-9888
