Question on availability under Simple Store

Does anyone know if this has been addressed with the roll out of “Simple Store”

If you are currently a part time associate avaible certain days of the week and only work 4-5 hrs per day total not to exceed 16 max 20 hrs

Will they now schedule you the 30 hrs per week and override your availability

What if you have a disability?

I can’t see them consecutively just giving everyone 30 hrs a week but I CAN see them scheduling over the number of hours you can work using that excuse of business needs or some made up excuse or that part timers are required to have open availability like the full time people were required to have before this all started

Should I clarify this with Corp HR?

Is it in the simple store handbook?

Get used to the new normal. You will follow every rule to a tea. You will do your training to the percentage called for or you will be written up (covers SHC but* in case of law suit). You will work only the hours you are scheduled, no more no less (covers SHC lawsuit). You will take a break or lunch when you are suppose to and you will not work 1 minute past your time (saves money) or clock in 1 minute early (saves money). If you clock in or out early or late your schedule will reflect this the next pay period (hours cut) and you will be written up.

If you are hourly full time you are maxed out at 30 hours. This means that you cannot work over 30 hours a week. Most likely you will only work 20-25 hours a week except at Christmas.

If you are part time you will max out at 20 hours and probably less.

If you are commission your commission will be cut unless you are one of the few stores who are taking appliances and mattresses to the front of the store or are moving them to a smaller store.

Benefits will be cut or become more expensive. Retirement will be cut.

You will also be required to sign a form that says that if minimum wage goes up you will not get a raise compatable to the minimum going up if you now make over minimum wage. Such as: if you now make 50 cents over minimum and minimum goes up 50 cents you will not still be making 50 cents more than everyone else. You will now be making minimum wage, even if you have been there 5 years. 10 years etc. You will be making the same as someone who just started.

If we have a 6 min lewAy for clocking in or out they will write you up if you punch out within that 6 minutes???

That kinda sheds a new light on what happened this morning at my sears store,

Me and my friend always like getting in building no later than 7:45 to take our coats off test the Palm Pilots see which ones work along with the many batteries with issues

Anyway it’s snowing and freezing, wind blowing and we are at door at 7:40 ringing the buzzer over and over and finally the store manager comes slow as molasses at 7:55am and says

“ well you don’t start til 8”

Well no but we are FREEZING outside you chump

Simple store has nothing to do with hours per se. With the cuts and changes even though they tell you that you are now full time 30 hours, you will never get 30 hours. Maybe, get 25 max. but mostly 20-25, sometimes only 10. Right now most people in our store are working 3 days with 8 hours each day and some only have 10 hours for the week and some no schedule at all. The 30 hours is just so that they can call you in if they need you, or at Christmas. There is no more overtime. If you get overtime or go over your hours or don't take a lunch be prepare to be written up.

In our store we have been doing this for about a year and we are told that we work our schduled hours, no overtime, no clocking in early, no clocking in late. You have a 4-6 minute grace window with clocking out, which means that if I get off at 3:00 and I clock out at 3:06 then I get written up. Payroll is monitored very closely.

We have even been told that if we are with a customer and we need to clock out to get someone else to help them. Welcome to the new Sears/Kmart

They really can’t demand anything as you are not full time and get no benefits. What they can do is choose not to schedule you if not needed. Can’t expect someone to have open availability on part time hours. Food and shelter are important hence people having multiple jobs.
