Laying off older employees for cheaper workforce

Finally after 11 years and 10 good performance appraisals I suddenly got a "does not meet expectations" on my review. I had received no mid year eval or any write-ups that year, just a poor eval with totally off the wall comments. I put 2 and 2 together and it dawned on me that my GM had realized my age (I look younger) and that I was over the $55k pay threshold. It had absolutely nothing to do with performance. I was put on a PIP and I actually tried to work through it , although I knew it was a lost cause. Staples tried to contest my unemployment claim, but the problem was they had fired to many people that way. The administrator of my claim actually said Staples is playing games and approved my claim, as they had for several others Staples had contested by order of VS.

You are not the the only one in this, @OmWZfCH-2haf. Somebody actually sued them for age discrimination and won recently. Not that that changed their operations, though, this is being done every day still.

California. The asst mgr class action started in ca, so I'm sure that the rest of the company will have to follow suit, if they're still around...

It would be interesting to hear Sycamore's opinion on all these lawsuits. I know big corps are sued all the time but will they change the behavior?

It may be a little more difficult for plaintiffs to win with Trump trying to stack the NLRB and courts with pro business admins and judges.

This also happened to me. They brought in two new employees in their early 30s and are paying them half of what I was making. I did not have a PIP. I was simply handed walking papers and they explained it was to to "re-aligning" the sales force. See you in court Staples!

Sorry is that California or Canada that has a gm lawsuit running? Good for you guys. Hit them for $50 million. The idiots just don't learn.

Ca already has a gm class action going stating that the gm's are no longer managing 50% of the time since we are on the sales floor so much, and therefore eligible for ot.

This unwritten but active policy to eliminate older higher salaried employees has been going on since at least 2007. These folks are scum and deserve nothing but the respect scum deserves. They tried this crap on me .... survived two PIPS and eventually forced them to not only pay me a severance but also a bonus. The PIPS were always a JOKE! I simply stopped doing ANYTHING else except work on the items in the PIP. Those numbers always improved and everything else went to hell, but the PIP went away. They are NOT particularly smart people. So in summary; unethical, unintelligent scum run Staples.

Time to start loading them up with a bunch of age discrimination suits. If one $26 million dollar settlement doesn't make them rethink their SOP then maybe 20 or 30 or more will.

Any new hires know if they are making people sign arbitration binders, trying to prohibit lawsuits? I know they made people sign off an electronic form saying they acknowledge they could be dismissed without cause at any time.

Sales managers won a $42 million settlement in 2010 for unpaid overtime. Looks like it's the GMs turn now. With the lack of payroll GMs are working on the floor tasking an additional 15-20hrs a week just trying to keep up.

Quill has been doing that for years. They won't keep older, more tenured employees and won't hire anyone who seems to be 33+.
