Can we sue ADP for ageism?

Does anybody know if anybody actually tried to sue ADP for ageism, and is it even an option? A friend has been let go after decades with the company for no reason. He was always an exemplary employee, with clean record, and yet his spot has been filled by somebody 30 years his junior. I'd be nice to know if there are any legal options he can explore.

That's not ageism. Those are entry level positions, all companies do that in an effort to recruit those fresh out of college. Nothing says you have to be a certain age, just a recent grad. And there is no age limit to a college graduate.

There was a job posted to Linkedin for ADP Maitland I found today. It was for a technical support position. The title was Technical Application Analyst I - May 2019 Grads Only.

Tell me that's not ageism

Today anyone can sue for anything. But just because you can doesn’t mean you should.

To sue ADP for age discrimination would be a huge waste of money and time because you won’t win.

All of these layoffs are carefully planned and thought out. Each time a layoff is done a list goes out to those affected and they always include people of various ages and job titles so they are not targeting in specific group. There is an entire legal department armed with a bunch of smart lawyers ready to jump on any lawsuits that are filed.

The last thing to mention is when you get layed off in order to get any severance package they are offering you need to sign a waiver that says you will not sue for any reason either now or in the future.

Age has nothing to do with being laid off. You are making to much money because you have been there for years and they are cutting the higher paid workers and replacing them with cheaper labor.

Everyone has the right to piss and moan about losing a job however trying to file a lawsuit is a waste of time.

What ADP is doing is unethical and immoral, but legal. ADP and many other companies have "at will employment" where either party (employer or employee) can terminate the employment relationship at any time for any reason. No explanations need be provided.

You need to consult an attorney, I would encourage you not to telegraph or post your intent to sue ADP. Without millions of dollars, and an army of attorneys, no law firm will take on ADP because they will get crushed! ADP has a lot of money, and the best legal representation. The state of Utah is a right to work state. They can fire you for any reason at any time, or the employee can terminate the relationship at any time. Just move forward, and understand that ADP looks good on your resume....

I bet he was making a higher wage being with the company for so many years and they went with the new normal routine, hire younger and cheaper unskilled workers who have no experience.

New hires can almost treat working for ADP as a payroll temp employment agency. Long term employment no longer exist with ADP.

Did he get severance? They did this to many associates not in "strategic" locations. It is really sad! And going to hurt the company!
