Thread regarding Hewlett Packard Enterprise (HPE) layoffs

Any one contact a lawyer regarding recent layoffs?

My perception of the layoff I was a part of on June 30, 2017 is that it was age related. They now want me to sign a 9 page waiver saying I have no rights to pursue any disagreement/dispute I may have with them. If I do not sign I will not receive their measly severance package. Can anyone say Class Action Law Suit.

NOTE: It has nothing to do with HIGHER SALARIES - I WAS UNDERPAID - OVER 50 - WHITE AND LAID OFF. Meg herself said she wanted a younger workforce - 40 and younger (Why doesn't she start with herself) -- she wanted 8o% offshore and 20% in the USA. She calls Baby Boomers (undesirables). 70% of the same day of people laid off are over 40. Plus 90% American Citizens nationalized or born here. The next week they are actively recruiting in Costa Rica - seen email with VP promoting themselves and saying how happy to see the good future of HPE in their emails and sent an email out of replacements for Project Managers they laid off with Costa Rica Project and Program managers even before the same project and program managers were still there before their last day. Talk about being so bold to do this while they are still in the company is amazing. They didn't even wait until the last day. Horrible treatment. They will get big bonuses for this.

Yes, this is true, the lawyers at http://hpagediscriminationinvestigation.com/ have signed up complainants (plaintiffs) who DID yea verily sign on the dotted line! The legalese (in at least some cases) was not bullet-proof enough, or so they are saying...

(What you say is true, then, is what I am confirming).

Age and higher overall compensation (base salary+benefits) are not mutually exclusive

as selection criteria for WFRs. It's simple formula:

  1. Older age = more experienced = higher base pay (some exceptions)

  2. Older age = medical benefits cost the company more than younger employees

  3. Older age (longer tenure) = accrual more vacation days

  4. etc, etc, so forth so on...

You get the picture... bottom line => Biggest savings in shortest amount of time is the goal...

Well then, when you can catch HPE laying you off (because "your job no longer exists"), and then immediately opening up the exact same job description for "a new graduate" person, that is when you need to re-apply for your old job, telling them that you are willing to take the lower pay! And then, they WILL turn you down for said "new" job! Because HPE management ego can NEVER accept the idea that they made a mistake in laying you off in the 1st place, you know, because once you have HPE_management-decreed cooties, you have cooties forever...

THAT is when you need to threaten to sue for age discrimination! You have caught them flat-footed! If you are astute, you can merely threaten to sue (doing timely due diligence with your state's EEOC folks and their paperwork, not even bothering to get all tangled up in lawyers), and they will be forced to settle! All IF they pull this stunt of laying you off, and then immediately opening up your same job to a lower-paid "new college grad", and you apply, and are turned down...

They have been known to be that stupid and clueless, and can be taken down accordingly...

I'm over 50. Did 18 months before getting wfr. I saw this a year out. You people who have never been let go, dont worry. I've been through this a dozen times. Literally. Im a niche EE and it takes daily resume submittals. Meg isnt doing this for a golden parachute. She has some grand master plan for changing the company. The cuts are to the higher salaries. Which looks like age but its cost. She has 2 billion dollars and a nuerosurgeon husband. Any of us would retired 1.9 billion dollars ago. Built awesome hobby rooms, give to charity, and take our kids on adventures. CEO s seem to have a screw loose. Their only enjoyment seems to be power chasing change the world. They desire something I dont understand.

To "More Carrion for The Meggot, the Mickey and Meggot only care about their own "yellow brick road" to fatten up their own "pot of gold"... they both are "laser focus" on one thing...golden parachutes out of DXC.. they don't have to worry about looking for another job or their family maybe subject to financial hardship due to WFR's. Criminals!!!

I know that we are all "anecdotes", and our experiences vary, but I keep in touch with (one particular person in) the old work group that I was laid off from, when in my mid-fifties. I worked my patootie off, lots of overtime, and gave up vacations. Got laid off anyway... They immediately replaced my with some youngster, who usually doesn't make it into the office before 10 AM. The group's work has ground to a near-halt, with schedules slipped a year and more! But... The Meggot has said, let the oldsters go, and hire youngsters. The Meggot Has Been Obeyed... So the lower management (Yes-men) is / are all cool with it all, no problems with those slipped schedules and non-existent work ethic... As long as The Meggot is obeyed and presumably happy!

Problem is, those pimple faced text book jockeys don't know $4!7 from shinola. Products are suffering in part because of it. Without the depth of experience, the company is headed for a train wreck.

There are two things going on here. 1) you're probably a higher cost employee and 2) they are trying to change the company. We can't change the company with the long-term employees trying to keep things in the past. It has less to do with age and more to do with money and change.

I'm not sure how many companies you have worked for but that waiver is standard practice pretty much everywhere. What I do know is that by law, you don't have to sign it right away. You can seek opinions and/or legal counsel before accepting it.

Last I heard, a class action lawsuit is already underway (I don’t know if it is scheduled in court yet; these things can drag on and on).
