Can a technician that was involved in a union vote and lost under "USA" and is now "ATS" try to organize another election and not have to wait a full year since they are now technically another company?

Y'all better hurry up and organize before you lose your benefits and have to pay for your own don't say I didn't warn you a little insight to what 2018 will look like for ATS guys
They played it like a different company for Oakland. Guys and gals that signed or in process of signing were prohibited to go. Some even signed documents and were verified by government. Sign on bonuses in writing were not paid. So that may be your ticket to go... Good Luck!
Apparently, yes. Bronx ATS techs are organizing right now.
here's a quote from the NLRA guide:
Effect of prior election. Section 9(c)(3) prohibits the holding of an election in any collective-bargaining unit or subdivision thereof in which a valid election has been held during the preceding 12-month period. A new election may be held, however, in a larger unit, but not in the same unit or subdivision in which the previous election was held.
not sure if this is 100% applicable to ATS/Altice but I guess we will soon see.
