The last election was interesting. It was a choice between a liar or a bigot. Damned if you do.... Damned if you don't. You lose either way. Which reminds me.......
The ATS offer ultimatum is very straightforward and to the point. It doesn't add or subtract. The beginning sounds very tempting (Founders bonus)... but it ends with a warning. It mentions the "bonus", but NOT the salary reduction. After all, they both go together. You don't get the bonus unless you agree to your 10% loss. Very, very clever.
Here is verbatim (in exactly the same words as were used originally.) the Altice Technical Services offer that was presented to YOU GUYS as your only alternative.... TWO CHOICES.
Altice Technical Services Offer
I, , acknowledge that I have read and understand the compensation terms associated with my opportunity to accept employment with Altice Technical Services or remain employed by Altice USA as set forth on the ATS Data Sheet delivered to me by Altice USA. I choose the following as set forth on the ATS Data Sheet delivered to me by Altice:
O Move my employment to Altice Technical Services with my current base compensation and Founders Bonus opportunity.
O Continue my employment with Altice USA with my current base compensation.
I further acknowledge and agree (1) nothing herein alters my at will employment status with Altice USA and, if I have chosen to move my employment to Altice Technical Services, my employment status with Altice Technical Services will be at will and (2) nothing herein creates any employment rights or privileges not already provided to me.
"Continue my employment with Altice USA with my current base compensation."
Question: What will be your duties if you had selected the second option? You're a technician. ATS is the tech side. What is expected of you with Altice USA? I don't have a clue, but I hope you do.
Question: I also noticed that the first option mentions the Founders bonus, but the second option fails to mention the 2% kicker. Was that purposely left out for YOU to "catch the bait"? Hmmmm....
And let's NOT forget that you are an AT-WILL employee. It's mentioned twice in the final paragraph.... as a reminder. The last sentence is the ABSOLUTE REMINDER, ".... nothing herein creates any employment rights or privileges not already provided to me.
Question: What EXACTLY are YOUR RIGHTS as an at-will employee?
From Findlaw.com, the meaning of at-will employee:
That is, the employer does not have to have good cause to terminate your employment. Most employers take advantage of this protection. Unless you signed some sort of employment contract that states you cannot be terminated without good cause, it is assumed that you are an at-will employee.
JESUS, fellas...
YOU CAN'T MAKE THIS STUFF UP !
It's NOT too late.
