Thread regarding Hewlett Packard Enterprise (HPE) layoffs

H1Bs for Meg

HPE has recently WFR'd a number of software engineers in Fort Collins. So why then are they applying for H1B visas for 10 software engineers??? (it's a rhetorical question .... I know the answer)

Interesting that they didn't check a box (yes or no) in the following:

Displacement: Non-displacement of the U.S. workers in the employer's workforce

Secondary Displacement: Non-displacement of U.S. workers in another employer's workforce; and

Recruitment and Hiring: Recruitment of U.S. workers and hiring of U.S. workers applicant(s) who are equally or better qualified than the H-1B nonimmigrant(s).

  1. I have read and agree to Additional Employer Labor Condition Statements A, B, and C above and as fully explained in Section I - Subsections 1 and 2 of the Labor Condition Application - General Instructions Form ETA 9035CP.

Can we as normal, puny mortals simply NOT check ANY of the critical boxes on our IRS tax-return forms, and get away with it? Or are there different rules for different strata of society?

You don't check the boxes the right way... Meaning, you are not willing to sign on the dotted line, that you are obeying the law and it's intent... You do not get any H-1B allocations! It's that simple! Well, it SHOULD be that simple!

Yet the Trumpler (Who Trumples on the Intent of the Law) and His Minions, cannot see fit to enforce the laws, it seems to me!

As another commenter here commented... The Fox (who is going to Make the Henhouse Great Again) can't seem to be bothered to rein in His Fellow Foxes...
