Know your Wage Rights for your State

For reference, per Colorado State Law, they are in compliance as long as you are paid within ten calendar days of the close of the pay period. The pay period closed this past Saturday Oct. 22nd, meaning that Tuesday November 1st is the last physical day they can pay us and remain in compliance with state laws.

However, they appear to be in violation of the Colorado Wage Act (1st link below) in that they are required to make a written posting in a conspicuous place any change to a regular payday in advance. I have taken photo evidence of our wages poster at the Home Office, which displays no such written notice of the change in our regularly scheduled payday. I took this photo at roughly 11 am, following the meeting called to make the announcement.

In addition, it appears that on Wednesday, Oct. 26th, 2016 at 7:14pm, the HR director sent out a notice to the home office specifically informing us that our paychecks would be available today, Friday Oct. 28th, hand-delivered by 11am.

At roughly 9:30am this morning, October 28th, 2016, the executives called a meeting to inform us that we at the Home Office, and the majority of the employees at the various campus locations would not receive their checks until Tuesday, Nov. 1st.

This is not considered appropriate notice and it is within your rights to file a complaint with the Colorado Department of Labor. There is information included within the links below on how to file a complaint should you choose to do so.

Employees at the campus level should check on their state’s division of labor laws for any similar Wage Acts to determine their potential recourse.

Don't be surprised if doors are closed soon. Word is that the lawsuit insurance has lapsed which means that Heritage will have to pay cash to defend themselves. That is a very sticky situation.

i agree. this isn't helping. i'm glad the ceo is out. if there's any way we can get through this. we gotta do it together.

I know emotions and frustrations are running high. But we have GOT to get through this together. If they see we are coming undone, we are not helping ourselves.

Whoa....what? How many students did Heritage send to collections when they couldn't pay their student loans? I've seen coworkers written up for being 15 minutes late. Was that "causing more conflict and problems"? No. Demanding the monies due you for hours worked is not "causing more conflict". If we pull out of this, do you think they will cut you slack when you are late or need a day off? No way. You reap what you sew.

Seriously, who is filing a complaint going to help? If you care about Heritage College and the employees I believe you should let the owner make things right.... Or at least try... Without causing more conflict and problems to the situation.
